Additional Information:  
City of Newark wishes to accept the NJDEP, GA Program matching grant awarded in the amount of $1,500,000.00 and the Office of Natural Resource Restoration grant in the amount of $300,000.00.

WHEREAS, the Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park is a Federally-authorized project along the Passaic River from Bridge Street to Brill Street in the City of Newark being undertaken by the US Army Corps of Engineers in partnership with the City of Newark and the New Jersey Department of Environmental Protection (NJDEP); and
 
WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (New Jersey), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
 
WHEREAS, pursuant to Resolution 7R1-f, adopted on August 5, 2009, the City of Newark accepted a matching grant award from the New Jersey Department of Environmental Protection, Green Acres Program (the "NJDEP") in the amount of $1,715,000.00 and authorized the Mayor and/or his designee, the Acting Business Administrator, to enter into a grant agreement with the NJDEP for the development of the following project: GA #0714-06-025; Minish Park Passaic Riverfront Development Project; and
 
WHEREAS, the matching funds required by the above grant agreement were satisfied through Resolution 7R1-f, adopted on August 5, 2009, by reallocating funds in the amount of $1,525,000.00 from the UEZ Grant #06-98 as well as reallocating funds in the amount of $190,000.00 (accepted and authorized pursuant to Resolution 7R3-C adopted April 15, 2009) from the Essex County Open Space Trust Fund's Open Space Local Aid Program; and
 
WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program intends to increase Green Acres funding for the Minish Park Passaic Riverfront Development Project by $1,500,000.00 with an equal amount of matching funds required by the City of Newark (a copy of the grant award letters are attached hereto and made a part of hereof); and
 
WHEREAS, the Office of Natural Resource Restoration has also agreed to commit an additional $300,000.00 to the Minish Park Passaic Riverfront Development Project with no matching funds required from the City of Newark; (a copy of the grant award letter is attached hereto and made a part of hereof); and
 
            WHEREAS, The Mayor and/or his designee, the Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development, have its matching share of the project, in the amount of $1,500,000.00 from a grant in the amount of $2,651,809.00 from United States Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program (accepted and authorized pursuant to Resolution 7R3-D(S) adopted April 23, 2013); and
 
WHEREAS, the City of Newark wishes to accept the New Jersey Department of Environmental Protection, Green Acres Program matching grant awarded in the amount of $1,500,000.00 and the Office of Natural Resource Restoration grant in the amount of $300,000.00; and
 
WHEREAS, the applicant is willing to use the State's funds in accordance with its rules, regulations and applicable statues, and is willing to enter into an Amendment of the Agreement with the New Jersey Department of Environmental Protection for the above-named project.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The grant awards in the total amount of $1,500,000.00 from the New Jersey Department of Environmental Protection, Green Acres Program are hereby accepted for the project known as Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park (a copy of the award letters are attached hereto and made a part hereof).
  2. The grant award in the amount of $300,000.00 from the New Jersey Department of Environmental Protection, Office of Natural Resource Restoration is hereby accepted for the project known as Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park (a copy of the award letter is attached hereto and made a part hereof).
  3. The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Environmental Protection to receive and expend the grant awards in the total amount of $1,500,000.00 for the project known as Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park (a copy of the Agreement is attached hereto and made a part hereof).
  4. The agreement between the City of Newark and New Jersey Department of Environmental Protection is hereby ratified from the Project Period as defined in the Agreement to the date of adoption of this authorizing resolution.
  5. The Mayor and/or his designee, the Business Administrator and the Deputy Mayor/Director, of the Department of Economic and Housing Development shall provide matching funds in the amount of $1,500,000.00 from a grant in the amount of $2,651,809.00 from United States Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program accepted and authorized pursuant to Resolution 7R3-D(S) 042313.
  6. In the event the State's funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project.
  7. The Mayor and/or his designee, the Business Administrator, agrees to comply with all applicable federal, state, and local laws, rules, regulations in its performance of the project.
  8. The Business Administrator shall file a fully-executed copy of the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.
  9. This Resolution shall take effect immediately.
 
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Mayor and/or his designees, the Business Administrator, and the Deputy Mayor/Director of the Department of Economic and Housing Development for grant funding from the New Jersey Department of Environmental Protection, Green Acres Program and Office of Natural Resource Restoration for the project known as Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park, and furthermore, ratifies and authorizes Mayor and/or his designee, the Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute an agreement with and accept grant funds in the amount of $1,500,000.00 from New Jersey Department of Environmental Protection for the project known as Joseph G. Minish Passaic River Waterfront Park and Historic Area a/k/a Minish Park a/k/a Newark Riverfront Park for the Project Period defined in the as defined in the Agreement. Matching grant funds in the amount of $1,500,000.00 shall be provided from the municipal budget.
