WHEREAS, the City of Newark is in need of  consulting services to assist in obtaining accreditation from the New Jersey State Association of Chiefs of Police ("SACOP"), including rewriting and revising existing Newark Police Department orders, policies, procedures, rules and regulations to ensure compliance with SACOP standards; and
 
WHEREAS, the services are specialized and qualitative in nature requiring expertise, extensive training and proven reputation in the field of endeavor, in this instance the field of police accreditation, as such these services are considered an Extraordinary Unspecifiable Service pursuant to N.J.S.A. 40A:11-5(1)(a)(ii), and does not require  public bidding; and
 
WHEREAS, pursuant to the Fair and Open process of State Pay-to-Play Law N.J.S.A. 19:44A-20.5, the City of Newark publicly advertised a Request for Proposal (RFP) for this service on July 24, 2013 and received one (1) proposal from Frank Rodgers, trading as The Rodgers Group, LLC, on August 22, 2013; and
 
WHEREAS, upon review by the Newark Police Department the proposal received from Frank Rodgers, trading as The Rodgers Group, LLC was found to be advantageous to the Police Department, based on price, experience and all other criteria listed in the RFP; and
 
WHEREAS, the Director of the Newark Police Department desires to enter into a contract with Frank Rodgers, trading as The Rodgers Group, LLC,  6 Lincoln Avenue, Toms River, New Jersey, 08753, for the provision of consulting services, for an amount not to exceed One Hundred Nineteen Thousand Dollars ($119,000.00), for the period commencing January 1, 2014 and terminating on December 31, 2014; and
 
WHEREAS, the process utilized to award this contract meets the requirements of a Fair and Open process pursuant to State Pay-to-Play Law N.J.S.A. 19:44A-20.5; and
 
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract and this vendor has certified that he/she has not made a reportable contribution in violation of the Executive Order or the State Pay-to-Play Law N.J.S.A. 19:44A-20.5 and will not do so during the term of this contract, which would constitute a breach of contract; and
 
WHEREAS, the State Local Public Contracts Law (N.J.S.A 40A:11-1, et seq.) requires a resolution authorizing the award of contracts for Extraordinary Unspecifiable Services, which exceeds the bid threshold.
 
 
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Business Administrator, and the Police Director, are hereby authorized to enter into and execute an Extraordinary Unspecifiable Services contract with Frank Rodgers, trading as The Rodgers Group, LLC,  6 Lincoln Avenue, Toms River, New Jersey 08753, for the provision of consulting services to assist in obtaining accreditation from the New Jersey State Association of Chiefs of Police ("SACOP") including rewriting and revising existing Newark Police Department orders, policies, procedures, rules and regulations to ensure compliance with SACOP standards,  for the period commencing on January 1, 2014 and terminating on December 31, 2014 for an amount not to exceed One Hundred Nineteen Thousand Dollars ($119,000.00) payable in twelve (12) equal monthly payments.
 
2.      This is a contract which shall be awarded in one (1) fiscal year although the date on which it properly takes effect falls in the next fiscal year.  Accordingly, this contract is subject to the availability and appropriation of sufficient funds in the year in which it takes effect.  N.J. Admin. Code 5:30-5.5(e).  Funds for this contract in the amount not to exceed One Hundred Nineteen Thousand Dollars ($119,000.00) shall be provided from the City of Newark/Police Department Budget.
 
3.      This contract was awarded pursuant to the Fair and Open procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5) and pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (a)(i) and (ii)) and is in compliance with the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5) and Newark Executive Order on Pay to Play, MEO-07-0001, effective March 31, 2007.
 
4.      There shall be no amendments or changes to this contract, unless in writing, signed by the parties, with approval of the Municipal Council.
 
5.      There shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16.
 
6.      A copy of the Certificate of Extraordinary Unspecified Services shall be placed on file with the contract in the Office of the City Clerk.
 
7.      A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of its passage.
 
8.      A fully executed copy of the contract herein authorized shall be forthwith filed in the Office of the City Clerk by the Director of the Newark Police Department.
