WHEREAS, then Council Member and now Municipal Council President, Mildred C. Crump and Council Member Ras J. Baraka (hereinafter, the Municipal Council Members), were in need of immediate legal services for two (2) litigated matters ( entitled "Cory Booker, et al, Plaintiffs vs Ronald C. Rice," et al, Docket No.: L-8586-12, and "Ras Baraka, et al vs Robert Marasco, et al," Docket No.: L-8636-12, and related appeals) (hereinafter, the "Litigations"), which both related to a legal dispute concerning the filling of the Municipal Council seat left vacant by the resignation of the former Municipal Council President, now United States Representative Donald M. Payne, Jr.; and
WHEREAS, the Office of the City Clerk, on behalf of the Municipal Council members, hired Pickett & Craig, Attorneys at Law, who maintain offices at 80 Main Street, Suite 430, West Orange, New Jersey 07052, to provide the necessary legal services in the Litigations, which engagement was not subject of a contract authorized by Municipal Council; and
WHEREAS, the Deputy City Clerk has confirmed that the Municipal Council Members received the benefit of those services; and
WHEREAS, the Deputy City Clerk has confirmed that Pickett & Craig has submitted invoices and/or statements of account supporting those charges; and
