WHEREAS, the United States Urban Areas Security Initiative ("UASI") Grant Program's mission is to enhance regional preparedness in major metropolitan areas through direct assistance to participating jurisdictions in developing an integrated regional system for prevention, protection, response and recovery from terrorist events or natural catastrophes; and
 
WHEREAS, the Northern New Jersey UASI is comprised of the counties of Bergen, Essex, Hudson, Middlesex, Morris, Passaic and Union as well as the core cities of Newark and Jersey City; and
 
WHEREAS, in November 2003 the Northern New Jersey UASI formed the Metro Urban Search and Rescue Strike Team ("MUST") to provide first response capability to acts of terrorism and natural disasters, especially when these events take place in transportation infrastructures such as bridges, tunnels, and railways; and
 
WHEREAS, the Northern New Jersey UASI has agreed to fund an initiative for the procurement of a Shoring Support Vehicle from a grant (09-10) issued by the United State Department of Homeland Security; and
 
WHEREAS, the City of Newark as one of the core cities comprising UASI and as a member of the USAR Strike Team is slated to receive a Shoring Support Vehicle; and
 
WHEREAS, the Newark Fire Department or local government of the City of Newark shall be the title holder of the vehicle and shall maintain current registration of the vehicle; and
 
WHEREAS, the Northern New Jersey UASI recommends that a well-equipped and staffed Shoring Support Vehicle would best serve the State and surrounding areas if it were to be stored, maintained, staffed and deployed from the Township of Millburn Fire Department Facility; and
 
WHEREAS, the Township of Millburn Fire Department shall be responsible for all costs and expenses related to the maintenance, replacement of parts and damage to the vehicle not otherwise covered by insurance, and
 
WHEREAS, the City of Newark Fire Department shall purchase insurance or add the vehicle to its current policy and the Township of Millburn Fire Department shall reimburse the City of Newark for the costs associated with doing so; and
 
WHEREAS, on February 18, 2013 the City of Newark Business Administrator  entered into and executed a Memorandum of Understanding with UASI, MUST and the Township of Millburn Fire Department  to cooperate with each other on the use, staffing and storage of the vehicle; and  
 
WHEREAS, a copy of said Memorandum of Understanding is attached to this resolution and made a part hereof; and      
 
WHEREAS, there will be no expenditure of municipal funds.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the City of Newark Fire Department are hereby ratified and authorized to accept receipt of a Shoring Support Vehicle from the date of its receipt to the date of adoption of this authorizing resolution; and
 
2.      The Mayor and/or designee, Business Administrator is hereby authorized to enter into a Memorandum of Understanding with UASI, MUST and the Township of Millburn Fire Department to store, maintain, staff and deploy a Shoring Support Vehicle (a copy of the Memorandum of Understanding is attached hereto and made a part hereof).
3.      The Municipal Council hereby ratifies the execution of the Memorandum of Understanding with UASI, MUST and the Township of Millburn Fire Department from February 18, 2013 to the date of adoption of this authorizing resolution.
 
4.      The Director of Finance is hereby authorized to receive from the Township of Millburn Fire Department the costs associated with the City purchasing insurance or adding the Shoring Support vehicle to the City of Newark's current insurance policy.   
 
5.      No municipal funds are required for receipt of the Shoring Support Vehicle.
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Director of the City of Newark Fire Department to accept receipt of a Shoring Support Vehicle from the Northern New Jersey UASI to provide first response to acts of terrorism and natural disasters especially when these events take place in transportation infrastructure such as bridges, tunnels, and railways.   Furthermore, this resolution ratifies and authorizes the Business Administrator to enter into a Memorandum of Understanding with UASI, MUST and the Township of Millburn Fire Department to store, maintain, staff and deploy the Shoring support vehicle.
