WHEREAS, the Municipal Council of the City of Newark, New Jersey has established a requirement that all Special Law Enforcement Officers be a resident of the City of Newark; and
 
WHEREAS, at the time of the establishment of this requirement there was a list of Special Law Enforcement Officers that were not residents of the City of Newark seeking reappointment, which the Council did not feel should have to comply with this new residency requirement; and
 
WHEREAS, the ordinance establishing the new residency requirement provided an exemption for these Special Law Enforcement Officers; and
 
WHEREAS, it is the position of the Municipal Council that no additional names be added to the 2012 list of Special Law Enforcement Officers that were not residents of the City of Newark at that time; and
 
WHEREAS, by state statute, Regular Police Officers in a Civil Service jurisdiction, are not required to be residents of the municipality in which they work; and
 
WHEREAS, the residency requirement in the City of Newark revised ordinances for Special Law Enforcement Officers will prevent a Police Officer who retires from the City of Newark Police Department and seeks employment as a Special Law Enforcement Officer from being appointed as a Special Law Enforcement Officer; and  
 
WHEREAS, the 2013 list of individuals to be appointed as Special Law Enforcement Officers that are not residents of the City of Newark includes additional names not listed in 2012 as a result of the appointment of retired Newark Police Officers.
 
NOW HEREFORE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
 
The Municipal Council does hereby agree to and approve the 2013 list of individuals that are not residents of the City of Newark to be appointed as Special Police Officers.
 
No additional names may be added to this list.
 
Any individual currently on the 2013 list of nonresidents appointed as Special Law Enforcement Officers who is removed from the list by moving into the City of Newark may not return to the list at a later date.
 
Any current Special Law Enforcement Officer that is a resident of the City of Newark who elects to move to a place of residents outside of the City of Newark shall relinquish his/her right to be appointed as a City of Newark Special Police Officer.
 
It is the position of the Municipal Council that all new appointees to be Newark Special Law Enforcement Officers, with the exception of the non-resident list of 2013, be residents of the City of Newark
 
STATEMENT
 
This ordinance establishes a list of non-residents that may continue to be re-appointed as Special Law Enforcement Officers. It also restates the requirement that all new appointees to be Special Law Enforcement Officers must be residents of the City of Newark.
