WHEREAS, the State of New Jersey Department of Law and Public Safety, Division of Highway Traffic Safety (DHTS) is responsible for the administration of the Drunk Driving Enforcement Fund (DDEF).  The fund was established by N.J.S.A. 39:4-50.8; and
 
WHEREAS, Municipalities, the Division of State Police, interstate law enforcement agencies and county law enforcement agencies may apply to DHTS to use DDEF monies for additional DWI enforcement patrols and any appropriate measures pertaining to other DWI enforcement activities authorized by the DDEF administrative regulations, N.J.A.C. 13:86-1.1 et seq. and approved by the Director; and
 
WHEREAS, within the City of Newark there are violations of the State of New Jersey's drunk driving statute and the Newark Police Department endeavors to address these violations.  The Newark Police Department wishes to make application to the DHTS to utilize DDEF funding in order to assign additional patrols to address DWI violators; and
 
      WHEREAS, on behalf of the City of Newark, the Police Director submitted an application to the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, requesting funding in the amount of $13,912.54 from the FY2011 Drunk Driving Enforcement Fund (DDEF) Program to fund police overtime initiatives to address drunk driving violations within the City of Newark, with no City funds required; and
 
WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of $13,912.54 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety for police overtime initiatives to address drunk driving violations within the City of Newark, for the period commencing on July 1, 2011 and terminating at such time when funds are expended; and
 
WHEREAS, the City must execute a grant agreement with the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety in order to obtain the grant award with no City funds required.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Police Director, are hereby authorized to submit an application to the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety requesting grant funding in the amount of $13,912.54 from the DDEF for police overtime initiatives to address drunk driving violations within the City of Newark with no City funds required (a copy of the application is attached hereto and made a part hereof).
    2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
    1. The grant award in the amount of $13,912.54 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
    2. The Mayor and/or his designee, the Police Director are hereby authorized to enter into and execute grant documents with the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety to receive and expend the grant award in the amount of $13,912.54 for police overtime initiatives to address drunk driving violations within the City of Newark for the period commencing on July 1, 2011 and terminating at such time when the funds are expended. (a copy of the Agreement is attached hereto and made a part hereof).
    1. The agreement between the City of Newark and State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety is hereby ratified from July 1, 2011 to the date of adoption of this authorizing resolution.
    1. No municipal funds are required for receipt or acceptance of this grant award.
    1. The Police Director shall file a fully-executed copy of the grant application, the grant award letter and the grant agreement, in the Office of the City Clerk.
 
 
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Police Director to submit an application for grant funding from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, for police overtime initiatives to address drunk driving violations within the City of Newark, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Police Director, to enter into and execute an agreement with and accept grant funds in the amount of $13,912.54 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, for police overtime initiatives to address drunk driving violations within the City of Newark for the period commencing on July 1, 2011 terminating at such time when the funds are expended.  No municipal funds are required.
