WHEREAS, the Department of Child and Family Well-Being provides medical care services pursuant to and consistent with Health Care Program Statutes (Section 330 of Public Health Services Act: 42 U.S.C. Section 254b), Program Regulation (43CFR part 51 and 42 CFR 56.201) for Community and Migrant Health Centers and Grant Regulations (42 CFR part 74), Affordable Health Care Act pertaining to FQHC Government Statutes; and
 
WHEREAS, the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) has made funds available for the provision of such services; and
 
      WHEREAS, On August 8, 2012, on behalf of the City of Newark, the Director of the Department of Child and Family Well-Being submitted an application to the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) FY 2013, Hubert H. Humphrey Building, 200 Independence Avenue, S.W.  Washington, D.C. 20201, requesting a grant in the amount of two million, two hundred ninety-three thousand, five hundred sixty-three dollars and zero cents ($2,293,563.00), for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark; and
 
WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of two million, two hundred ninety-three thousand, five hundred sixty-three dollars and zero cents ($2,293,563.00) from the United States Department of Health and Human Services/Health Resources and Service Administration (HRSA) for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark for the period November 1, 2013 through October 31, 2014; and
 
WHEREAS, the Director of the Department of Child and Family Well-Being is the appointed authority to comport and comply with all the FQHC Statues as required by the grant; and
 
WHEREAS, the United States Department of Health and Human Services/Health Resources and Service Administration (HRSA), does not require the City to execute a grant agreement in order to accept the grant award; and
 
WHEREAS, the City of Newark recognizes that the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) may extend time of the Grant Award and/or provide additional funds if made available; and
 
WHEREAS, the Mayor and the Director of the Department of Child and Family Well-Being desire to extend the time of the Grant Award and/or accept additional funds as they may become available from the Department of Health and Human Services/Health Resources and Services Administration (HRSA); and
 
WHEREAS, the City of Newark, Department of Child and Family Well-Being shall, upon receipt of additional funding, and or extension of time, file an amending resolution reflecting an extension of the Grant time and or amount of additional funds made available to the City; and
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, are hereby authorized to submit an application to the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA), Hubert H. Humphrey Building, 200 Independence Avenue, S.W., Washington, D.C.  20201, requesting grant funding in the amount of two million, two hundred ninety-three thousand, five hundred sixty-three dollars and zero cents ($2,293,563.00), for the continued provision of health care services to the medically underserved populated areas which includes the City of Newark, no city funds required  (a copy of the application is attached hereto and made a part hereof).
 
2.      The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
 
3.      The grant award in the amount of two million, two hundred ninety-three thousand, five hundred sixty-three dollars and zero cents ($2,293,563.00), from the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
 
4.      The City of Newark, Department of Child and Family Well-Being shall file an Amending Resolution upon receipt of notice of extension of time and or additional funding, stating the time of the extension and the amount of additional funds to be awarded.
 
5.      The grant agreement between the City of Newark and United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) are hereby ratified from November 1, 2013 to the date of adoption of this authorizing resolution.
 
6.       No municipal funds are required for receipt or acceptance of this grant award.
 
7.      The Director of the Department of Child and Family Well-Being shall file fully executed copies of the resolution, grant application and grant award letter in the Office of the City Clerk.
                                         
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Mayor and the Director of the Department of Child and Family Well-Being to apply for and accept grant funds in the amount of two million, two hundred ninety-three thousand, five hundred sixty-three dollars and zero cents ($2,293,563.00), from the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA for the period commencing on November 1, 2013 and terminating October 31, 2014. No municipal funds are required from the municipal budget.
