WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $126,081.60 for the Body Armor Replacement  Program and no adequate provision has been made in the 2014 temporary budget for the aforesaid purpose and N.J.S.A 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
 
      WHEREAS, by Resolution 7R11-d  dated December 18, 2013 the City of Newark accepted the Body Armor Replacement Fund Grant in the amount of $126,081.60 for the purpose of purchasing protective vests for Newark Police Officers; and
 
      
      WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
WHEREAS, the emergency appropriations adopted in 2014 pursuant to N.J.S.A. 40A:4-20 including this resolution total $53,009,845.60.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, no less than two-thirds of all members therefore affirmatively concurring, THAT:
1.  An emergency appropriation is and the same is hereby made for the following classification:

2.      Said emergency appropriation shall be provided for in the 2014 budget.

      STATEMENT
 
 
This legislation hereby establishes an appropriation in the amount of $126,081.60 for the Body Armor Replacement Grant,  funded by the New Jersey Office of the Attorney General, Department of Law and Public Safety, Division of Criminal Justice for offsetting the costs associated with replacing body vest for police officers for the period November 27, 2013 through November 26, 2018 (City-wide).
