WHEREAS, Resolution No. 7R4-A, adopted July 7, 2011, authorized the Director of the Department of Engineering to accept the bid proposal and execute Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, with Daidone Electric, Inc., 200 Raymond Boulevard, Newark, New Jersey 07105 , for an amount not to exceed $1,615,000.00; and
WHEREAS, Resolution No. 7R4-B, adopted February 6, 2013, authorized the Director of the Department of Engineering to issue Change Order No. 1 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, extending the term of the contract to September 1, 2013; and
WHEREAS, during construction nine (9) locations that were part of the original scope of work and only originally required replacing the old copper cables with fiber optic cables, were found to have damaged conduits that required replacement in order to install the fiber optic cables. This additional work is required in order to complete the traffic signal interconnect that was part of the contract scope of work; and
WHEREAS, additional equipment is required in order to monitor traffic and fully communicate with all the traffic signals that were part of the original scope of work from the Division's Traffic Control Center; and
WHEREAS, the attached Change Order No. 2 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, increases the original contract amount by $276,747.37, thereby bringing the total amount of this contract to $1,891,747.37, which is in compliance with the regulations governing construction contract change orders, N.J.A.C. 5:30-11.7 and 11.8; and
WHEREAS, the attached Change Order No. 2 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, also extends the time to complete actual construction to June 30, 2014, which is permitted by the Local Public Contracts Law, N.J.S.A. 40A:11-15(9).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to execute Change Order No. 2 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, for the amount of $276,747.37, thereby amending the contract amount from $1,615,000.00 to $1,891,747.37.
2. The term of this contract is amended from December 14, 2011 through September 1, 2013 to December 14, 2011 through June 30, 2014.
3. Attached hereto are Certifications of Funds issued by the Acting Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $276,747.37 for the purpose set forth hereinabove. A copy of this Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
4. Funds for Change Order No. 2 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, in the amount of $276,747.37 is provided as below:

5. A fully executed copy of Change Order No. 2 to Contract No. 16-2010R, shall be filed in the Office of the City Clerk by the Director of Engineering.
6. The Municipal Council ratifies this contract amendment from September 1, 2013 to the date of adoption of this resolution.
7. No other changes to this contract are allowed without prior
Municipal Council approval.
8. Consistent with the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-15(9), the Director of the Department of
Engineering is authorized to extend the time of the contract for the
completion of actual construction.
STATEMENT
This Resolution authorizes and ratifies that the Mayor and/or his designee and the Director of the Department of Engineering, to issue Change Order No. 2 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, with Daidone Electric, Inc. by increasing the contract amount by $276,747.37, thereby bringing contract total from $1,615,000.00 to $1,891,747.37, and amending the contract term to December 14, 2011 through June 30, 2014.
