WHEREAS, pursuant to a competitive process, the Municipal Council through Resolution 7R3-i, adopted on August 7, 2013, authorized the Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development to enter into and execute a fair and open Community Development Block Grant ("CDBG") Sub-recipient Agreement with Comunidad Unida Para Rehabilitacion de Adictos, Inc., ("C.U.R.A."), 35 Lincoln Park, Newark, New Jersey, 07102, (hereinafter, the "Sub-recipient"), for the total contract amount of $75,000.00, from CDBG funds received for Program Year 2012-2013, to perform physical rehabilitation services to its facility located at 75 Lincoln Park, Newark, New Jersey 07102 ("Project"), for the period of January 1, 2013 through December 31, 2014; and
 
WHEREAS, due to unforeseen financial constraints, the Sub-recipient has requested additional CDBG funds to assist with the completion of the Project; and
 
WHEREAS, the Acting Director of the Department of Economic & Housing Development seeks authorization to enter into a First Amended Sub-recipient Agreement with the Sub-recipient to increase the contract amount by $125,000.00 from the CDBG funds received for Program Year 2012-2013, for a total amended amount not to exceed $200,000.00, to allow the Sub-recipient to complete the Project; and
 
WHEREAS, all other terms and conditions contained in the CDBG Agreement authorized by Resolution 7R3-i 080713 shall continue in full force and effect with the exception of the increased contract amount authorized through this Resolution; and
 
WHEREAS, the First Amended CDBG Agreement with the Sub-recipient to increase the contract amount by $125,000.00 is in compliance with Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and all Statutes and Regulations governing the use of  Community Development Block Grant funds; and
WHEREAS, this contract is being awarded to a non-profit corporation and as such is not governed by State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001.  As a non-profit organization the Sub-recipient is therefore not required to submit certain disclosure statements.
 
            NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      Resolution 7R3-I 080713 is hereby amended and the Mayor and/or his designee, the Business Administrator and the Acting Director of the Department of Economic & Housing Development, are hereby authorized to enter into and execute a First Amended Sub-recipient Agreement with Comunidad Unida Para La Rehabilitacion de Adictos ("C.U.R.A."), 35 Lincoln Park, Newark, New Jersey 07102, thereby increasing the contract amount by $125,000.00, from CDBG funds received for Program Year 2012-2013, for a total amended amount not to exceed $200,000.00, for the period January 1, 2013 through December 31, 2014, to allow the Sub-recipient to complete the Physical Rehabilitation services to its facility located at 75 Lincoln Park, Newark, New Jersey 07102 ("Project"), which is further described in the "Scope of Services" attached hereto as Exhibit A.
 
2.      The First Amended Sub-recipient Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2013 to the date of adoption of this authorizing resolution.
 
3.      The total amended compensation to be paid to the Sub-recipient pursuant to said First Amended Sub-recipient Agreement is $200,000.00 and shall be paid from CDBG funding received for the Program Year 2012-2013.
 
4.      The terms of the contract may only be waived or amended and signed by the parties duly authorized to execute this contract, subject to the approval of the Newark Municipal Council by Resolution.
 
5.      The First Amended Sub-recipient Agreement is being awarded to the Sub-recipient pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, State Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and complies with all Statutes and regulations governing the use of  Community Development Block Grant funds, and the City's Executive Order Number MEO-07-0001, effective March 31, 2007.
 
6.      Attached hereto is a Certification of Funds from the Municipal Comptroller of the City of Newark, which states that: (1) there are sufficient funds in the amount of $125,000.00 for the purpose set forth hereinabove and (2) that the line appropriation of the official budget which shall be charged is: Business Unit: NW027; Department: A13; Div./Proj.:  EW350; Activity: A; Account: 72090; Budget Ref. B2013.
 
7.      An executed copy of said First Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Business Administrator.
 
8.      All other terms and conditions of the Sub-recipient agreement authorized by Resolution 7R3-i 080713 remain the same.
 
 
 
STATEMENT
 
This resolution ratifies and amends Resolution 7R3-i 080713 and authorizes the Mayor and/or his designee, the Business Administrator and the Acting Director of the Department of Economic & Housing Development, to enter into and execute a First Amended Sub-recipient Agreement with Comunidad Unida Para La Rehabilitacion de Adictos ("C.U.R.A."), 35 Lincoln Park, Newark, New Jersey  07102, thereby increasing the contract amount by $125,000.00, from CDBG funds received for Program Year 2012-2013, for a total amended amount not to exceed $200,000.00, for the period January 1, 2013 through December 31, 2014, to allow the Sub-recipient to complete the Physical Rehabilitation services to its facility located at 75 Lincoln Park, Newark, New Jersey 07102.
