Body

WHEREAS, Ordinance 6PSF-b adopted on December 19, 2012, establishes a requirement that all Special Law Enforcement Officers be a bona fide resident of the City of Newark; and

WHEREAS, in 2013, the Newark Police Department ("NPD") recruited three (3) non-resident individuals to enter the Essex County Police Academy ("Police Academy") for training as Special Police Officers; and

WHEREAS, these individuals have incurred significant expenses entering the Police Academy with the expectation of becoming Special Police Officers upon successful completion of the class and graduation; and

WHEREAS, the NPD requests that the Municipal Council exempt from the residency requirement due to their reliance upon the NPD's representations made during recruitment and entrance into the Academy, the following three (3) individuals:

WHEREAS, the NPD did not intentionally seek to recruit non-residents and will ensure compliance with the Ordinance's residency requirements going forward.

NOW THEREFORE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:









1. The Municipal Council exempts from the residency requirements for Special Police Officers, the three recruits who entered into the Police Academy in 2013, based upon their recruitment by the Newark Police Department and successful completion of their training and graduation on July 2014. Those individuals are :
