WHEREAS, the City of Newark is in need of procuring a vendor to design, implement, operate, manage and administrate a customized 340B program, including consultation on processes and software to support the evaluation, planning and implementation, dispensing, inventory control, replenishment, reporting and auditing of 340B program and other pharmacy transactions to eligible patients consistent with Federal and State Laws and Guidelines for the City of Newark Department of Health and Community Wellness, Federally Qualified Health Centers; and  
 
WHEREAS, N.J.S.A. 40A:11-4.1 b (2) , specifically authorizes municipalities to use competitive contracting for the hiring of a for-profit or a not-for-profit entity incorporated under Title 15A of the New Jersey Statutes for the purpose of: the operation, management or administration of a social service facilities or programs; and  
 
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3 (a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and
 
WHEREAS, the competitive contracting process shall be administered by the Business Administrator and/or the Purchasing Agent, on behalf of the Department of Health and Community Wellness pursuant to N.J.S.A. 40A:11-4.3 (b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of subsection e. of N.J.S.A. 40A:11-4.5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Municipal Council hereby authorizes the use of competitive contracting   pursuant to N.J.S.A. 40A:11-4.1 et seq., to procure specialized goods and services related to 340B program, specifically, to procure a vendor to design, implement, operate, manage and administrate a customized 340B program, including consultation on processes and software to support the evaluation, planning and implementation, dispensing, inventory control, replenishment, reporting and auditing of 340B program and other pharmacy transactions to eligible patients consistent with Federal and State Laws and Guidelines for the City of Newark Department of Health and Community Wellness, Federally Qualified Health Centers.
      
2.      The award of such a contract(s) shall be by resolution and approval of the Municipal Council.
 
3.      The competitive contracting process shall be administered by the Business Administrator and/or the Purchasing Agent on behalf of and with the assistance of the Department of Health and Community Wellness pursuant to N.J.S.A.40A:11-4.3 (b).
