AN ORDINANCE AMENDING TITLE 2, CHAPTER 2, SECTION 64, OFFICE OF THE MAYOR AND AGENCIES, MUNICIPAL COURT, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, INCREASING THE APPLICATION FEE FOR REPRESENTATION BY A MUNICIPAL PUBLIC DEFENDER

WHEREAS, pursuant to N.J.S.A. 2B:24-17, the City is authorized to impose an application fee for representation by the Municipal Public Defender; and
WHEREAS, it has been determined that there is a need to increase the fee in order to cover the costs incurred in providing the services of municipal public defenders;
WHEREAS, the increase represents an increase consistent with fees charged by similarly situated municipalities.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. Title 2. Administration. Chapter 2, Office of the Mayor Agencies, Section 64, Municipal Court, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, be and the same is hereby amended as follows:

2:2-64.7 Public Defender Fees
Any person applying for representation by the Municipal Public Defender
must pay a fee of $50.00 $200.00.
Section 2. All prior articles or parts thereof which are inconsistent with
this article are hereby repealed.
Section 3. This article shall take effect upon final passage and
publication in accordance with the law.
STATEMENT
The Ordinance amends Title 2, Chapter 2, Section 64.7 and authorizes the City of Newark to increase the application fee for persons seeking representation by the Municipal Public Defender pursuant to N.J.S.A. 2B:24-17 from $50.00 to $200.00.
