WHEREAS, Resolution 7R4-d adopted, June 6, 2013, authorized the Director of the Department of Engineering to execute Contract #18-2012 Renovations to Engine 13 Fire House, 714-728 Mount Prospect Avenue, Newark, New Jersey 07107, with Falak Construction, Inc., 836 Ridgewood Avenue, North Brunswick, New Jersey 08902, in the total bid amount of $344,976.00; and
WHEREAS, due to conditions discovered after the contract was awarded and interior demolition work had begun, certain minor changes to the scope of work were needed to address field conditions; more specifically (a) constructing a concrete apron instead of using an asphalt sealer as specified to address rodent and water infiltration in the laundry room; and (b) installing a gas line supply for the installation of a gas powered dryer, instead of an electric powered dryer (in part because of electric power issues and to achieve certain economies), as well as installing a new subpanel as required by electrical inspector [See Attachment A, Change Orders #1 and #2]; and
WHEREAS, the Director of the Department of Engineering has represented that these change orders are in compliance with N.J.A.C. 5:30-11.3 and 11.8, as they do not materially expand the size, nature of scope of the project, are due to unforeseen problems and conditions, and will effect cost savings.; and
WHEREAS, the Director of the Department of Engineering desires to amend Contract #18-2012 to an increase of $11,467.17 in the total amount of the contract, thereby amending it from an amount not to exceed $344,976.00 to $356,443.17.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of Engineering, are hereby authorized to execute Change Order/Amendment #1 to Contract #18-2012, Renovations to Engine 13 Fire House, 714-728 Mount Prospect Avenue, Newark, New Jersey 07107, project with Falak Construction, Inc., 836 Ridgewood Avenue, North Brunswick, New Jersey 08902,to amend the contract as follows: an increase of $11,467.17 in the total amount of the contract, thereby amending it from an amount not to exceed $344,976.00 to $356,443.17.
2. All other terms and conditions of Contract #18-2012 Renovations to Engine 13 Fire House, 714-728 Mount Prospect Avenue, Newark, New Jersey 07107, project shall apply and remain in force
3. A fully executed copy of Change Order/Amendment #1 to Contract #18-2012 Renovations to Engine 13 Fire House, 714-728 Mount Prospect Avenue, Newark, New Jersey 07107, project shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
4. Funds for this contract in the amount of $356,443.17 shall be provided by the Essex County Improvement Authority ("ECIA") through the Bank of New York Mellon and payments made for this project shall be monitored by the City of Newark, Department of Finance.
5. No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
6. Notice of the award of this contract amendment shall be published in a newspaper ten (10) days of adoption.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of Engineering, to execute Change Order/Amendment #1 to Contract #18-2012 Renovations to Engine 13, Fire House, 714-728 Mount Prospect Avenue, Newark, New Jersey 07107 Project with Falak Construction, Inc., 836 Ridgewood Avenue, North Brunswick, New Jersey 08902, to an increase of $11,467.17 in the total amount of the contract, thereby amending it from an amount not to exceed $344,976.00 to $356,443.17.
