WHEREAS, Resolution 7R12-a July 3, 2012 authorized the award of Contract 03-WS2012 (Rebid) Concrete Sidewalk Restoration over Water and Sewer Excavations to Nagi Construction Co. Inc., 52 Great Hills Road, Millburn, New Jersey 07041, in the amount of $192,000.00, in accordance with the Local Public Contracts Law N.J.S.A. 40A:11-5 et seq.; and
 
WHEREAS, Contract 03-WS2012 (Rebid) was completed and is to be closed out with a total of $4,639.27 to be increased for modifications from the total contract amount with a contract time increase of 30 calendar days; and
 
WHEREAS,      the Department of Water and Sewer Utilities wishes to execute Final Quantities Change Order No. 01 to Contract 03-WS2012 (Rebid) Concrete Sidewalk Restoration over Water and Sewer Excavations, with Nagi Construction Co. Inc., 52 Great Hills Road, Millburn, New Jersey 07041, increasing the contract by $4,639.27, bringing the final contract amount to $196,639.27, and extending the contract completion time to 30 days.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.         The Municipal Council hereby authorizes the Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, to execute Final Quantities Change Order No. 01 to Contract 03-WS2012 (Rebid) Concrete Sidewalk Restoration over Water and Sewer Excavations with Nagi Construction Co. Inc., 52 Great Hills Road, Millburn, New Jersey 07041, increasing the contract by $4,639.27, bringing the final contract amount to $196,639.27, and extending the contract time by 30 calendar days.
 
2.         The additional funds in the amount of $4,639.27 required for this Final Quantities Change Order No. 01 are provided as follows: Business Unit NW037, Dept. ID750, Division/Proj. 7505, Account 71960.
 
3.      A fully executed copy of the Final Quantities Change Order No. 01 shall be filed in the Office of the City Clerk and, if necessary, with the New Jersey Department of Environmental Protection, by the Acting Director of the Department of Water and Sewer Utilities.
 
4.      If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
