WHEREAS, the United States Department of Justice ("USDOJ"), Office of Juvenile Justice and Delinquency Prevention ("OJJDP") solicited proposals for the Community-Based Violence Prevention Demonstration Program (the "Grant"), which encourage cities to develop community-based strategies to reduce crime, violence and recidivism; and
 
WHEREAS, in May 2011, the Newark Police Department, in partnership with the Department of Economic and Housing Development's, Office of Reentry, submitted an application (the "Application") to the USDOJ requesting grant funding in the amount of $2,196,085.00; and
 
WHEREAS, the Application proposed a historic opportunity to fund  a Community Based Violence Prevention Demonstration Program ("Newark's Hotspot Violence Prevention Initiative" or "Hotspot") using proven, evidence-based strategies that would, among other things: fund the hiring of approximately four (4) police officers to conduct community policing in specific crime grids where much of the violent activity in Newark occurs; fund community mentoring, case management, job development, and transitional jobs for 125 of the "highest risk" 16 to 30 year-olds, who are likely to perpetrate or be victims of shootings and murders; fund and support community mobilization and outreach by Newark residents; fund program oversight of grant operations; and
 
WHEREAS, similar programs such as Boston Ceasefire have resulted in proven methods of long-term and significant reductions in crime, which have created economic opportunity and contributed to long-term community stability; and
 
      WHEREAS, as a result of this Application, on August 31, 2011, the City of Newark was awarded a grant in the amount of $2,196,085.00 from the USDOJ to develop community-based strategies to reduce crime, violence and recidivism for a grant period commencing on October 1, 2011 and terminating on September 30, 2014; and
 
WHEREAS, pursuant to Resolution 7R3-A(S), adopted on June 12, 2012, the City accepted grant funds and entered into a cooperative agreement with USDOJ, for grant award 2011-PB-FX-K001, in the amount of $2,196,085.00 for the Hot Spot with approximately $150,333.00 due annually in Budget Years 2012, 2013 and 2014 for an approximate total of $450,999.00 that were to be borne by the City of Newark through its Municipal Budget for the health, dental, prescription benefits, stress differentials and pensions of the police officers hired, for the period commencing on October 1, 2011 and terminating on September 30, 2014; and
 
WHEREAS, the grant funds were not expended by the grant expiration date of September 30, 2014, therefore the Deputy Mayor/Director of the Department of Economic and Housing Development and the Police Director requested an extension of the termination date of the cooperative agreement from September 30, 2014 to December 31, 2015 through the submission of a Grant Adjustment Notice to USDOJ, which was approved by the USDOJ on February 12, 2013; and
 
WHEREAS, the City and the USDOJ wish to amend the terms of the Cooperative Agreement and extend the grant period to October 1, 2011 through December 31, 2015.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Director of the Department of Economic and Housing Development  is hereby authorized to submit a Grant Adjustment Notice to the United States Department of Justice ("USDOJ"), Office of Juvenile Justice and Delinquency Prevention ("OJJDP") for an extension of the termination date of the cooperative agreement from September 30, 2014 to December 31, 2015.
 
2.      The Municipal Council hereby ratifies its authorization of the submission of this Grant Adjustment Notice from the date of submission to the date of adoption of this authorizing resolution. (A copy of the USDOJ Grant Adjustment Notice approving the grant extension is hereby attached.)
 
3.      The cooperative agreement between the USDOJ, OJJDP and the City is hereby amended to extend the term of the grant period to October 1, 2011 through December 31, 2015.
 
4.      The amended cooperative agreement is hereby ratified from September 30, 2014 to the date of adoption of this authorizing resolution.
 
5.      The Mayor and/or his designees, the Director of Economic and Housing Development and the Police Director are hereby authorized to execute any grant documents necessary to effectuate this cooperative amendment.
 
6.      All other terms and conditions of the cooperative agreement remain in effect.
 
7.      No additional municipal funds for the Budget Year 2015 are required for the effectuation of this grant extension.
 
8.      The Director of Economic and Housing Development shall file a fully-executed copy of the Grant Adjustment Notice and any other grant documents necessary to effectuate this amendment, along with copies of the Certification of Funds for Budget Years 2012, 2013 and 2014 in the Office of the City Clerk.
 
 
STATEMENT:
 
This resolution hereby ratifies, amends and authorizes the actions taken by the Deputy Mayor/Director of the Department of Economic and Housing Development and the Police Director to submit a Grant Adjustment Notice for grant award 2011-PB-FX-K001 in the amount of $2,196,085.00 to the United States Department of Justice ("USDOJ"), Office of Juvenile Justice and Delinquency Prevention ("OJJDP") for an extension of the cooperative agreement termination date from September 30, 2014 to December 31, 2015, extending the term of the grant period to October 1, 2011 through December 31, 2015.  The Director of Economic and Housing Development and/or the Police Director is hereby authorized to execute any grant documents necessary to effectuate this amendment. All terms and conditions of the cooperative agreement remain in effect.  No additional municipal funds for the Budget Year 2015 are required for this grant extension.
