WHEREAS, the New Jersey "Clean Communities and Recycling Act" of 1981 created the Municipal Recycling Tonnage Grant Program, whereby municipalities could receive a grant for the amount of materials documented as being recycled during the previous calendar year; and

WHEREAS, in 1987, the New Jersey "Mandatory Source Separation and Recycling Act," specifically N.J.S.A. 13:1E-99.16, mandated that municipalities submit an annual Recycling Tonnage Report summarizing the amount of material recycled during the previous calendar year; and

WHEREAS, in 2008 the Director of Neighborhood and Recreational Services caused an annual Recycling Tonnage Report to be filed on behalf of the City of Newark with the New Jersey Department of Environmental Protection ("NJDEP") for calendar year 2007; and

WHEREAS, on or about November 4, 2009, the NJDEP awarded the City 2007 RECYCLING TONNAGE GRANT funds in the amount of $272,037.17 (see "Unallocated Grant Receipts" report attached hereto and made a part hereof); and
