         WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $962,380.00 for the FY 2014 Local Safety Program - Broad Street and South Street/ Tichenor Street and Lincoln Park and Dr. Martin Luther King Jr. Boulevard/Crane Street and 7th Avenue - Pedestrian Safety Project (Citywide) and no adequate provision has been made in the 2014 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
 
            WHEREAS, on May 7, 2013, the Pedestrian Safety Project was approved in the amount of $500,000.00 by Resolution #7R1-b(S). Also, on March 5, 2014 Pedestrian Safety Project was approved in the amount of $1,282,897.00 by Resolution # 7R1-g. On May 22, 2014, the North Jersey Transportation Planning Authority (NJTPA), notified the City of Newark on May 22, 2013 that the Broad Street and South Street (FY'2013 Local Safety Program) and, Broad Street and Tichenor Street/Lincoln Park (FY'2014 Local Safety Program)  projects were to be combined into one project, which will allow construction to occur simultaneously. The Department of Engineering is requesting approval for $962,380.00 bringing the total for Pedestrian Safety Project to $2,745,277.00; and
 
            WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
            WHEREAS, emergency appropriation adopted in 2014, pursuant to N.J.S.A. 40A: 4-20 including this resolution total...…………………$258,838,194.37.
 
                         NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
  
1.      A temporary emergency appropriation be and the same is hereby made for the following classification.

2.      Said emergency appropriation shall be provided for in the 2014 budget.
 
3.      A copy of this resolution shall be immediately filed with the Director of Local Government Services by the City Clerk of the City of Newark.
 
 
STATEMENT
 
This legislation establishes the appropriation for the FY 2014 Local Safety Program - Broad Street and South Street/Tichenor
and Lincoln Park and Dr. Martin Luther King Boulevard/Crane and 7th Avenue - Pedestrian Safety Project in the amount of $962,380.00.  The North Jersey Transportation Planning Authority is awarding the funds. The project period is 24 months from the date of federal authorization.
