WHEREAS, Resolution 7R4-a,  adoptedJune 6, 2013, authorized the Director of the Department of Engineering to execute Contract #14-2012 Renovations to the Department of Child and Family Well-Being, 110 William Street, Newark, New Jersey, with GPC, Inc., 20 E. Willow Street, Millburn, New Jersey 07041, in the total bid amount of $610,542.00; and
 
WHEREAS, due to conditions discovered after the contract was awarded and interior demolition work had begun, certain minor changes to the scope of work were needed to address field conditions; more specifically (a) roof work was performed during non-working hours due to health and safety concerns related to chemical odors of the built up tar roof and the impact on incoming patients [See Attachment A, Change Order #2R]; and
 
WHEREAS, the Director of the Department of Engineering has represented that these change orders are in compliance with N.J.A.C. 5:30-11.3 and 11.8, as they do not materially expand the size, nature of scope of the project, are due to unforeseen problems and conditions, and will effect cost savings; and
WHEREAS, the Director of the Department of Engineering desires to amend Contract #14-2012 to an increase of $7,325.91 in the total amount of the contract, thereby amending it from an amount not to exceed $610,542.00 to $617,867.91.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee and the Director of Engineering, are hereby authorized to execute Change Order/Amendment #1 to Contract #14-2012, Renovations to the Department of Child and Family Well-Being (n/k/a the Department of Health and Community Wellness), 110 William Street, Newark, New Jersey, project with GPC, Inc., 20 E. Willow Street, Millburn, New Jersey 07041,to amend the contract as follows: an increase of $7,325.9,1 in the total amount of the contract, thereby amending it from an amount not to exceed $610,542.00 to $617,867.91.
 
2.      All other terms and conditions of Contract #14-2012, Renovations to the Child and Family Well-Being (n/k/a the Department of Health and Community Wellness), 110 William Street, Newark, New Jersey, project shall apply and remain in force till the contract is completed.
 
3.      A fully executed copy of Change Order/Amendment #1 to Contract #14-2012, Renovations to the Department of Child and Family Well-Being (n/k/a the Department of Health and Community Wellness), 110 William Street, Newark, New Jersey, project shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
 
4.      Funds for this contract in the amount of $617,867.91 shall be provided by the Essex County Improvement Authority ("ECIA") through the Bank of New York Mellon and payments made for this project shall be monitored by the City of Newark, Department of Finance.
 
5.      No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
 
6.      A fully executed copy of this Change Order/Amendment shall be filed in the Office of the City Clerk by the Director of Engineering or his designee.
 
 
                  
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Engineering, to execute Change Order/Amendment #1 to Contract #14-2012, Renovations to the Department of Child and Family Well-Being (n/k/a the Department of Health and Community Wellness), 110 William Street, Newark, New Jersey, project with GPC, Inc., 20 E. Willow Street, Millburn, New Jersey 07041, to an increase of $7,325.91 in the total amount of the contract, thereby amending it from an amount not to exceed $610,542.00 to $617,867.91
