WHEREAS, the United States Department of Housing and Urban Development's (HUD) mission is to create strong, sustainable, inclusive communities and quality affordable homes for all, and in furtherance of its mission, HUD awards various grants, including Community Development Block Grants (CDBG), Emergency Solutions Grants (ESG), HOME Investment Partnership Act grants (HOME), and Housing Opportunities for Persons with AIDS grants (HOPWA); and
 
WHEREAS, the Mayor and the Municipal Council find and declare that continued efforts are required to provide decent and affordable housing for low- and moderate-income residents, including those with special needs; and
 
WHEREAS, the Mayor and the Municipal Council further find and declare that the welfare of the City and the well-being of its residents are dependent on the provision of planned physical and economic development initiatives, as well as supportive public services for mainstream and special needs populations, especially the homeless and people with AIDS; and
 
      WHEREAS, the City of Newark desires to further the public interest by obtaining funding from HUD for the provision of the above-referenced services to meet the needs of the citizens of Newark; and
 
WHEREAS, in order to receive CDBG, ESG, HOME and HOPWA grant funding, HUD requires the submission of a One-Year Action Plan; and
 
WHEREAS, the City's Department of Administration coordinated the preparation of the One-Year Action Plan for Program Year 2014 (September 1, 2014 through August 31, 2015) in conformity with HUD regulations and in the format attached herewith; and
 
WHEREAS, the City's Mayor and Assistant Business Administrator caused to be submitted the One-Year Action Plan for Program Year 2014; and
 
WHEREAS, as a result of submitting the One-Year Action Plan for Program Year 2014, the City of Newark was awarded $6,569,453.00 for CDBG, $548,578.00 for ESG, $1,853,743.00 for HOME and $6,473,182.00 for HOPWA, for a total of $15,444,956.00; and
 
      WHEREAS, the Mayor and the Assistant Business Administrator wish to accept the grant award and did execute and submit a grant agreement governing said award; and
 
      WHEREAS, subsequent to the above, the Mayor and the Assistant Business Administrator proposed a substantial amendment to the One-Year Action Plan so that $1,000,000.00 of the CDBG grant funds initially allocated to Recreational Centers could be expended on City demolition projects instead, and said substantial amendment was publicly advertised with opportunity provided for public comment; and
 
WHEREAS, no matching municipal funds are required for acceptance of the grant award; and
 
WHEREAS, no commitment of City resources or staff is required for acceptance of the grant award; and
 
WHEREAS, the grant funds will only be used to maintain already existing services, and will not be used to create a new service or to expand an existing service.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Assistant Business Administrator, are hereby authorized to submit a One-Year Action Plan with the U.S. Department of Housing and Urban Development for Program Year 2014 (September 1, 2014 through August 31, 2015), which contains $6,569,453.00 for CDBG, $548,578.00 for ESG, $1,853,743.00 for HOME and $6,473,182.00 for HOPWA, for a total of $15,444,956.00.
 
2.      The Municipal Council hereby ratifies its authorization of the submission of the One-Year Action Plan from the date of its submission to the date of adoption of this authorizing resolution.
 
3.      The above-described grant award in the total amount of $15,444,956.00, from the U.S. Department of Housing and Urban Development, is hereby accepted (copies of the award letter, the One-Year Action Plan, the Action Plan with Substantial Amendment and the City's Request For Proposals publicly advertising the availability of funding under the four programs - CDBG, ESG, HOME, and HOPWA - are attached hereto and made a part hereof).
 
4.      The Mayor and/or his designee, the Assistant Business Administrator, are hereby authorized to enter into and execute such grant documents and agreements with HUD as may be necessary to receive the above-described grant funds.
 
5.      The Municipal Council hereby ratifies its authorization of the execution of the grant documents and agreements from the date of their execution to the date of adoption of this authorizing resolution.
 
6.      The Municipal Council hereby authorizes and ratifies the substantial amendment to the One-Year Action Plan, and further authorizes the Mayor and/or his designee, the Assistant Business Administrator, to submit the Annual Action Plan with Substantial Amendment to HUD.
 
7.      No municipal funds are required for the receipt or acceptance of the grant funds.
 
8.      No commitment of City resources or staff is required for the receipt or acceptance of the grant funds.
 
9.      The grant funds shall only be used to maintain already existing services, and shall not be used to create any new service or to expand an existing service.
 
10.      The Assistant Business Administrator shall file fully-executed copies of the One-Year Action Plan for Program Year 2014 with Substantial Amendment, and any associated grant documents or agreements in the Office of the City Clerk.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Assistant Business Administrator, and the actions taken to submit the One-Year Action Plan and the One-Year Action Plan with Substantial Amendment with the U.S. Department of Housing and Urban Development for Program Year 2014 (September 1, 2014 through August 31, 2015), and further ratifies and authorizes the execution of the grant agreements necessary to receive the grant funds, and further authorizes the acceptance of the grant funds.
