AN ORDINANCE ADOPTING THE TENTH AMENDMENT TO THE URBAN RENEWAL PLAN FOR THE FAIRMOUNT URBAN RENEWAL PROJECT N.J.R 72 AND RENAME THE PLAN THE FAIRMOUNT URBAN RENEWAL PROJECT REDEVELOPMENT PLAN.

WHEREAS, the Municipal Council of the City of Newark previously adopted Resolution 7R3-a on November 13, 2014 referring the proposed 10th Amendment to the Urban Renewal Plan for the Fairmount Urban Renewal Project (to be renamed the Fairmount Urban Renewal Project Redevelopment Plan) to the Central Planning Board in order to determine if such an amendment is consistent with the City's Master Plan and for recommendations pursuant to N.J.S.A. 40A:12A-7(e) and directed the Central Planning Board to transmit its report on the amendment to the Municipal Council within forty-five (45) days of referral; and
 
WHEREAS, Resolution 7RB-L 080465, dated August 4, 1965, approved the original Urban Renewal Plan for the Fairmount Urban Renewal Project (the "Original Plan"); and
 
WHEREAS, the Municipal Council has adopted nine (9) previous Resolutions and amendments to the urban renewal plan as enumerated below:
1.      Resolution 7RB-d 032068 (1st Amendment);
2.      Resolution 7RB-d 041669 (2nd Amendment);
3.      Resolution 7RV 112470 (3rd Amendment);
4.      Resolution 7RCE 032173 (4th Amendment);
5.      Resolution 7RG 090573 (5th Amendment);
6.      Resolution 7RBT 030575 (6th Amendment);
7.      Ordinance 6S&FD 041879 (7th Amendment);
8.      Ordinance 6S&FF 110382 (8th Amendment);
9.      Ordinance 6S&FG 090788 (9th Amendment); and
 
WHEREAS, the Central Planning Board has reviewed the 10th Amendment to the Urban Renewal Plan for the Fairmount Urban Renewal Project (to be renamed the Fairmount Urban Renewal Project Redevelopment Plan); and has determined that the amendment is consistent with the City's Master Plan; and
 
WHEREAS, public hearing and comment was taken by the Central Planning Board on December 8, 2014; and
 
WHEREAS, on December 8, 2014, the Central Planning Board adopted a resolution recommending to the Municipal Council that the 10th Amendment to the Urban Renewal Plan for the Fairmount Urban Renewal Project (to be renamed the Fairmount Urban Renewal Project Redevelopment Plan) be adopted by the Council as referred and without change; and
 
WHEREAS, the Municipal Council has determined that it is in the best interest of the public to adopt the Tenth Amendment, as recommended by the Central Planning Board, in the form attached hereto.  
 
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:  
 
Section 1.      The Municipal Council hereby finds and determines that the Tenth Amendment generally conforms to the City's master plan and that it provides the maximum opportunity consistent with the sound needs of the locality as a whole for the urban renewal of this area by private enterprise.
 
Section 2.      The Municipal Council hereby adopts the Tenth Amendment.  The Tenth Amendment shall supersede all previous zoning standards and development regulations for the special redevelopment area set forth therein.  
 
Section 3.       The Municipal Council hereby amends the zoning district map of the City of Newark to reflect the rezoning of the special redevelopment area by the Tenth Amendment.  
 
Section 4.      The City Clerk is hereby directed to file a copy of the Tenth Amendment with the minutes of this meeting.
 
Section 5.      This Ordinance shall take effect in accordance with the laws of the State of New Jersey after final passage and publication.
 
STATEMENT
This ordinance adopts the Tenth Amendment to the Urban Renewal Plan for the Fairmount Urban Renewal Project (to be renamed the Fairmount Urban Renewal Project Redevelopment Plan).
