Whereas, the City of Newark Department of Health and Community Wellness- Metropolitan Medical Response System (MMRS) desires to provide training for thirty-six (36) participants in an incident management system training course.  The training provided will be a five (5) day All-Hazard Incident Management Team course to take place at the Office of Emergency Management, 480 Clinton Avenue, Newark, New Jersey 07108; and
 
Whereas, the City of Newark Office of Emergency Management and Homeland Security applied for and was awarded the FY'2013 Urban Area Security Initiative funding from the New Jersey Office of Homeland Security and Preparedness of which  the Department of Health and Community Wellness was a sub-recipient and approved funding for training (a copy of the adjusted award letter attached); and  
 
Whereas, the City of Newark accepted Urban Area Security Initiative grant funds from New Jersey Office of Homeland Security and Preparedness by Resolution  7R1-i-120413 (a copy of the resolution is attached); and
Whereas, the City of Newark Department of Health and Community Wellness- MMMRS was awarded $35,320.00from the FY'2013 Urban Area Security Initiative grant for training purposes by the New Jersey Office of Homeland Security and Preparedness which shall fund this procurement (a copy of the award letter/MMRS application is attached); and
 
Whereas, the Director of Health and Community Wellness desires to provide this training course from a federal General Services Administration contractor; and
 
Whereas, the State 2004 Appropriations Act, P.L.2004, c.71, and as described by the Division of Local Government Services in Local Finance Notice 2004-21 allows local units to purchase goods from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contracts Law, and through this resolution and properly executed contracts, the City of Newark plans to use such contracts to purchase goods to meet the requirements of the grant; and
Whereas, N.J.S.A. 52:34-10.6(c) authorizes the City to purchase goods/services paid for or reimbursed by federal funds awarded by the U.S. Department of Homeland Security without  public bidding if the contractor either (1) is a holder of a current State contract for the equipment or agency, or (2) is participating in a federal procurement program established by a federal department or agency, or (3) has been approved by the State Treasurer in consultation with the New Jersey Domestic Security Preparedness Task Force; and
 
Whereas, no State or Local funds will be used for this purchase; and
 
Whereas, Incident Management Training Consortium has the Government Services Administration (GSA) federally assigned contract number GS-02F-0152S for the desired training services.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
 
1.      Pursuant to N.J.S.A. 52:34-10.6 (c), a contract is awarded to Incident Management Training Consortium, 40282 Highway 41, Suite #7, Oakhurst, CA 93644, to provide an incident management system training course for thirty-six (36) participants in a five (5) day All- Hazard Incident Management Team course to take place at the Office of Emergency Management, 480 Clinton Avenue, Newark, NJ 07108 for the period commencing November 1, 2014 to June 15, 2015.  The contract amount shall not exceed $35,320.00.
 
2.      The Mayor and/or his designee, the Director of Health and Community  Wellness are authorized to procure services and utilize the GSA contract with Incident Management Training Consortium and execute any applicable contract and/or purchasing documents to the extent applicable.
3.      There shall be no amendments of this resolution without the approval of the Municipal Council.
 
4.      A Certification of Funds in the amount of $35,320.00 is attached.  
 
5.      The Director of Health and Community Wellness shall file a fully- executed copy of the contract, if applicable, with the Office of the City Clerk.
 
6.      The approval of this resolution will not require the expenditure of State or Local funds.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Health and Community Wellness, to procure services and utilize the GSA contract with Incident Management Training Consortium, 40282 Highway 41, Suite #7, Oakhurst, CA 93644, to provide an incident management system training course for thirty-six (36) participants in a five (5) day All- Hazard Incident Management Team course to take place at the Office of Emergency Management, 480 Clinton Avenue, Newark, New Jersey 07108, for the period commencing November 1, 2014 to June 15, 2015.  The contract amount shall not exceed $35,320.00.
