WHEREAS, the Department of Child and Family Well-Being, now known as the Department of Health and Community Wellness, provides medical care services pursuant to and consistent with Health Care Program Statutes (Section 330 of Public Health Services Act: 42 U.S.C. Section 254b), Program Regulation (43CFR part 51 and 42 CFR 56.201) for Community and Migrant Health Centers and Grant Regulations (42 CFR part 74), Affordable Health Care Act; and
 
WHEREAS, the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) has made funds available for the provision of such services; and
 
      WHEREAS, On August 15, 2014, on behalf of the City of Newark, the Director of the Department of Child and Family Well-Being, now known as the Department of Health and Community Wellness, submitted an application to the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) FY 2014, Hubert H. Humphrey Building, 200 Independence Avenue, S.W, Washington, D.C. 20201, requesting a grant in the amount of two million, three hundred eighty-two thousand, four hundred twenty-seven dollars and zero cents ($2,382,427.00), for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark; and
 
WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of two million, four hundred sixty-six thousand, one hundred thirty-four dollars and zero cents ($2,466,134.00) from the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark for the period November 1, 2014 through October 31, 2015; and
 
 
WHEREAS, the City of Newark recognizes that the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) may extend the time of the grant award and/or provide additional funds if made available; and
 
WHEREAS, the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) will amend the grant to reflect the grant time extension and/or increase or decrease of additional funds if made available; and
 
WHEREAS, the City of Newark, Department of Health and Community Wellness, shall, upon any extension of time of the grant and or increase or decrease of additional funds, file an amending resolution reflecting the final term and award amount of the grant; and  
 
WHEREAS, terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Newark Municipal Council by resolution.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, now known as the Department of Health and Community Wellness, are hereby authorized to submit an application to the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA), Hubert H. Humphrey Building, 200 Independence Avenue, S.W., Washington, D.C.  20201, requesting grant funds in the amount of two million, four hundred sixty-six thousand, one hundred thirty-four dollars and zero cents ($2,466,134.00), for the continued provision of health care services to the medically underserved populated areas which includes the City of Newark, no city funds required  (a copy of the application is attached hereto and made a part hereof).
 
2.      The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
 
3.      The grant award in the amount of two million, four hundred sixty-six thousand, one hundred thirty-four dollars and zero cents ($2,466,134.00),
from the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
 
4.      The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to receive and expend the grant award for the continued provision of health care services to the medically underserved populated areas which includes the City of Newark for the period commencing on November 1, 2014 and terminating on October 31, 2015 (a copy of the award letter is attached hereto and made a part hereof).
 
5.      The City of Newark, Department of Health and Community Wellness, shall upon any extension of time of the grant and or increase or decrease of additional funds, file an amending resolution reflecting the final time and award amount of the grant.
 
6.             The Municipal Council hereby ratifies the acceptance of this grant award from November 1, 2014 to date of adoption of this authorizing resolution.
 
7.       No municipal funds are required for receipt or acceptance of this grant award.
 
8.      The Director of the Department of Health and Community Wellness shall file fully executed copies of the resolution, grant application and grant award letter in the Office of the City Clerk.
                                         
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Mayor and the Director of the Department of Child and Family Well-Being, now known as the Department of Health and Community Wellness, to apply for and accept grant funds in the amount of two million, four hundred sixty-six thousand, one hundred thirty-four dollars and zero cents ($2,466,134.00), from the United States Department of Health and Human Services/Health Resources and Services Administration (HRSA) for the period commencing on November 1, 2014 and terminating October 31, 2015. No municipal funds are required from the municipal budget.
