WHEREAS, pursuant to the Fire Service Resource Emergency Deployment Act, N.J.S.A. 52:14E-11, et seq., and the regulations promulgated thereunder, including but not limited to N.J.A.C. 5:75A-2.2, municipalities in the State of New Jersey must prepare and adopt a fire mutual aid plan (hereinafter referred to as the "Fire Mutual Aid Plan"); and
WHEREAS, the Fire Mutual Aid Plan must set forth policies and procedures to coordinate the effective utilization of fire service resources where the implementation of the Fire Mutual Aid Plan is determined to be necessary or appropriate; and
WHEREAS, the Fire Mutual Aid Plan must be based upon the planning criteria, objectives, requirements, responsibilities and concepts of operation essential for the implementation of all necessary and appropriate protective or remedial measures to be taken in response to emergency incidents; and
WHEREAS, the Essex County Fire Coordinator, Essex County Office of Emergency Management, in conjunction with the Essex County Fire Chiefs Association, has developed a "Fire Mutual Aid Agreement between Participating Essex County Municipalities" (hereinafter referred to as the "Fire Mutual Aid Agreement"), a copy of which is attached hereto and made a part hereof; and
WHEREAS, the Director of the Newark Fire Department has reviewed the Fire Mutual Aid Agreement, found it to be acceptable and to be to the benefit of the City of Newark and its residents, and therefore recommends that the City of Newark enter into the Fire Mutual Aid Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the Mayor and/or his designee, the Director of the Newark Fire Department, to enter into and execute the "Fire Mutual Aid Agreement Between Participating Essex County Municipalities" in the form attached hereto.
2. The Fire Mutual Aid Agreement will continue indefinitely or until terminated or rescinded by all participating municipal fire departments.
3. The City of Newark may unilaterally withdraw from the Fire Mutual Aid Agreement at any time by providing the participating municipal fire departments and the Essex County Fire Coordinator with sixty (60) days' advance written notice of the withdrawal.
4. There shall be no amendment of the Fire Mutual Aid Agreement without the prior approval of the Municipal Council by resolution.
5. The Director of the Newark Fire Department shall provide a copy of the fully executed Fire Mutual Aid Agreement to the Office of the City Clerk.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Newark Fire Department, to enter into and execute a "Fire Mutual Aid Agreement between Participating Essex County Municipalities."
