AN ORDINANCE AMENDING TITLE IV ("ALCOHOLIC BEVERAGES"), CHAPTER 2 ("LICENSES"), SECTION 4:2-8.2 ("CLUB LICENSES; ISSUANCE REQUIREMENTS; REGULATIONS AND RESTRICTIONS") OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, TO AMEND THE REQUIREMENTS OF ACTIVE OPERATION FOR A CLUB LICENSE

WHEREAS, Section 4:2-8.2, Subsection b, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, currently provides in relevant part that no Club License for the sale of alcoholic beverages shall be issued to any club unless the club shall have been in active operation in the State of New Jersey for at least seven (7) years continuously immediately prior to the submission of the application; and
WHEREAS, the Director of the Newark Police Department, who oversees the City of Newark's Board of Alcoholic Beverage Control, recommends that said requirement of active operation be reduced from seven (7) years to five (5) years.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. Title IV, Chapter 2, Section 4:2-8.2, Subsection b, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is hereby amended to read in its entirety as follows (note: addition is shown in bold underlined and deletion as strikethrough):
4:2-8.2 Club Licenses; Issuance Requirements; Regulations and Restrictions.

b. No license shall be issued to any club unless it shall have been in active operation in the State for at least seven (7) years five (5) years continuously, immediately prior to the submission of the application, and shall have been in exclusive continuous possession and use of a club house or club quarter for the period of at least three (3) years continuously immediately prior to the submission of its application for a license.
