WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the "Redevelopment Law"), authorizes municipalities to determine whether certain land in the municipality constitutes an area in need of redevelopment; and

WHEREAS, in accordance with the Redevelopment Law and by Resolution 7R3-F(s), adopted on June 3, 2015, the Municipal Council (the "City Council") of the City of Newark (the "City") directed the Central Planning Board to conduct a preliminary investigation of certain property identified as Block 1913, Lot 2, more commonly known as 175-199 First Street, in the Central Ward of the City of Newark, in the County of Essex (the "Property"), to determine if the Property meets the criteria of an area in need of redevelopment under the Redevelopment Law; and

WHEREAS, the Central Planning Board adopted a Resolution on August 24, 2015 that determined that the Property does meet the criteria as an area in need of redevelopment under the Redevelopment Law; and

WHEREAS, pursuant to N.J.S.A. 40A:12A-4(a)(3) and N.J.S.A. 40A:12A-7, the City Council is empowered to adopt a redevelopment plan pursuant to which redevelopment projects are to be undertaken or carried out within an "area in need of redevelopment," and

WHEREAS, pursuant to that authority the City Council caused a redevelopment plan for the Property to be prepared, entitled the "Block 1913, Lot 2 Redevelopment Plan" (the "Redevelopment Plan"), attached hereto as Exhibit A; and

WHEREAS, simultaneously with this Ordinance, the Deputy Mayor/Director of the Department of Economic and Housing Development has sent a resolution to the Municipal Council that declares Block 1913, Lot 2 as an area in need of redevelopment (the "Redevelopment Area") and refers the Redevelopment Plan to the Central Planning Board, to determin...
