WHEREAS, the City of Newark, Department of Engineering, through a federally funded Local Scoping process has determined that Delancy Street which is located in Newark's East Ward, is in need of complete reconstruction between Avenue I and Rutherford Street; and

WHEREAS, the Department of Engineering's preferred alternative, referred to as Alternative 4 in the Delancy Street Local Scoping Project Alternative Analysis Report (a copy of the Local Scoping Project Alternative Analysis Report is attached hereto and made a part hereof), requires a right of way acquisition; and

WHEREAS, the City of Newark requires funds for the right of way acquisition and easements for Delancy Street between Avenue I and Rutherford Street; and

WHEREAS, on August 28, 2015, the City of Newark received a letter (a copy of the authorization letter is attached hereto and made a part hereof) from the North Jersey Transportation Planning Authority (NJTPA) advising that New Jersey Department of Transportation (NJDOT) funds are available in the amount of $1,900,000.00 (One Million Nine Hundred Thousand Dollars and No Cents) for the right of way acquisition required for ...
