WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY 2016 Bikeways State Aid Program provides grant funding for bicycle lane projects; and

WHEREAS, the City of Newark wants to improve access to transit for bicyclists by creating a protected bike lane connecting Penn Station and Broad Street Station in the City of Newark; and

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT FY 2016 Bikeways State Aid Program for construction of a bike lane connecting Penn Station and Broad Street Station in the City of Newark; and

WHEREAS, on October 15, 2015, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $492,250.00 (Four Hundred Ninety Two Thousand Two Hundred Fifty Dollars and Zero Cents) from the NJDOT FY 2016 Bikeways State Aid Program, for construction of the Greenway Bike Route, Downtown Transit Connector Project, Phase 2 in the City of Newark, identified as application BIKE-2016-Greenway Bike Route, Downtown Tran-00051, with no City funds being required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, are hereby authorized to submit an electronic grant application identified as BIKE-2016-Greenway Bike Route, Downtown Tran-00051 to the New Jersey Department of Transportation on behalf of the City of Newark, requesting grant funding in the amount of $492,250.00 (Four Hundred Ninety Two Thousand Two Hundred Fifty Dollars and Zero Cents) from the NJDOT FY 2016 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector Project, Phase 2, in the City of Newark, with no City funds being required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.

4. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Engineering and the City Clerk, are hereby authorized to sign the grant agreement on behalf of the City of Newark and their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.

5. No municipal funds are required for receipt or acceptance of this grant award.

6. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.

This resolution ratifies and authorizes the Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, to submit an electronic grant application, accept, and enter in agreement identified as BIKE-2016-Greenway Bike Route, Downtown Tran-00051 to the New Jersey Department of Transportation on behalf of the City of Newark, requesting grant funding in the amount of $492,250.00 (Four Hundred Ninety Two Thousand Two Hundred Fifty Dollars and Zero Cents) from the NJDOT FY 2016 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector Project, Phase 2, in the City of Newark with no City funds being required.
