WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2016 Municipal Aid Program ("NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal and county road and bridge projects; and
WHEREAS, the City of Newark needs to improve various roads that include drainage, ADA ramps, resurfacing, decorative crosswalks, and pavement markings throughout the City of Newark; and
WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 locations, MA-16) within the City of Newark
; and
WHEREAS, on October 15, 2015, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $1,855,707.00(One Million Eight Hundred Fifty Five Thousand Seven Hundred Seven Dollars and Zero Cents) from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 locations, MA-16) within the City of Newark, identified as application MA-2016-Street Resurfacing - Various Streets - 00619 for City of Newark with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application MA-2016-Street Resurfacing - Various Streets - 00619 for City of Newark, the Director of Department of Engineering, shall submit a copy of the grant agreement to the City Clerk, Corporation Counsel, and the Business Administrator.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application identified as MA-2016-Street Resurfacing - Various Streets - 00619 for City of Newark to the New Jersey Department of Transportation on behalf of the City of Newark requesting grant funding in the amount of $1,855,707.00 (One Million Eight Hundred Fifty Five Thousand Seven Hundred Seven Dollars and Zero Cents) from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 locations, MA-16) within the City of Newark with no City funds required (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.
4. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, are hereby authorized to sign the grant agreement on behalf of the City of Newark and their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.
5. Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the City Clerk, Corporation Counsel, and the Business Administrator.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of City Clerk.

This resolution ratifies and authorizes the Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, to submit an electronic grant application, accept, and enter in an agreement identified as MA-2016-Street Resurfacing - Various Streets - 00619 for City of Newark to the New Jersey Department of Transportation, on behalf of the City of Newark requesting grant funding in the amount of $1,855,707.00(One Million Eight Hundred Fifty Five Thousand Seven Hundred Seven Dollars and Zero Cents) from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 locations, MA-16) within the City of Newark with no City funds required.
