Body
WHEREAS, on September 29, 2015 the City of Newark, through its Director of Purchasing, advertised to solicit bids for contractors to provide five (5) 2016 or Newer Chevrolet Tahoe 4 WD, 4 Door LTZ through the Division of Motors, to the Police Department as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed four (4) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on October 15, 2015, three (3) bids were received in response to this advertisement; and
WHEREAS, the Manager of the Division of Motors reviewed the bids and recommended that an award be made to the lowest responsive, responsible bidder, Wigder Chevrolet Inc., 606 West Mount Pleasant Avenue, Livingston, New Jersey 07039; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A.40A:11-1 et seq., meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into a contract (Purchase Order), with Wigder Chevrolet Inc., 606 West Mount Pleasant Avenue, Livingston, New Jersey 07039, to provide five (5), 2016 or Newer Chevrolet Tahoes 4 WD, 4 Door LTZ to the City of Newark, whose bid was received on the advertised due date and determined to be the lowest responsive, responsible bidder in accordance with specifications. Upon adoption of the resolution by the Municipal Council, the term of the contract will be established, upon complete delivery, no later than December 31, 2015.
2. There shall be no amendment or change of this contract without the approval of the Newark Municipal Council.
3. Funds for this acquisition is encumbered on PO #2009, Fund NW026, Account 46120, Budget Year 2014, for the total of $273,720.00, pursuant to N.J.A.C. 5:30-5.4 (a)(b). This contract shall not to exceed $273,720.00.
4. It is the responsibility of the Director of the Department of Engineering, Division of Motors to ascertain that the 2016 or Newer, Chevrolet Tahoes, 4WD 4 Door LTZ are in compliance with the specifications, and will provide the Municipal Council, the Business Administrator and the Supervising Procurement Specialist with appropriate reports during the term of the contract.
5. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Supervising Procurement Specialist.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor and/ or his designee, the Supervising Procurement Specialist, to enter into a contract (Purchase Order), with Wigder Chevrolet Inc., 606 West Mount Pleasant Avenue, Livingston, New Jersey 07039, to provide five (5), 2016 or Newer Chevrolet Tahoes 4 WD, 4 Door LTZ to the City of Newark at a cost not to exceed $273,720.00.
