                      WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $200,000.00 for the FY 2016 Hazardous Discharge Site Remediation Program  and no provision has been made in the 2016 Temporary Budget for the aforesaid purpose; and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose  aforementioned; and

 

                     WHEREAS, by Resolution 7R3-a dated January 20,2016, the City of Newark accepted the United States Environmental Protection Agency (USEPA) Grant in the amount of $200,000.00 to conduct  Preliminary Assessment (P/A), Site Investigation (R/I) work at the City owned property located at 43-57 Clifton Street Block 2767, Lot 9 (South Ward). There is an In-Kind Match of $40,000.00 provided by the Community Development Block Grant for a project total of $240,000.00 The Hazardous Discharge Remediation Program, commencing on October 1,2014 and terminating September 30, 2017; and 

 

WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and

 

                     WHEREAS, emergency appropriation adopted in 2016 pursuant to N.J.S.A. 40A:4-20 including this resolution total...$2,020,121.00

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

                     1.  An emergency appropriation be and the same is hereby made for the following classification:

2.                     Said emergency appropriation shall be provided for in the 2016 budget.

 

3.                     A copy of this resolution shall be immediately filed with the Director of Local Government Services by the City Clerk of the City of Newark.

 

 

STATEMENT

 

This resolution establishes the temporary emergency appropriation in the amount of $200,000.00 for the FY 2016 Hazardous Discharge Site Remediation Program.  No Municipal funds need to be expended for this agreement except In-Kind Match in the amount of $40,000.00 provided by Community Development Block Grant for a Project total of $240,000.00. The contract period commences on October 1, 2014 and terminates September 30, 2017. Funding has been provided by the United States Environment Protection (USEPA) and an In-Kind Match provided by Community Development Block Grant (CDBG) (South Ward).
