WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provide funds for Local Safety Programs; and
WHEREAS, On June 24, 2014, the Municipal Council adopted Resolution 7R4-C which ratified and authorized the City of Newark, Department of Engineering to accept grant funding, and furthermore, ratified and authorized the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $1,595,061.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park, and $1,150,216.00 for Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street bringing the total program resources for all projects to $2,745,277.00 as set forth below:

WHEREAS, on May 19, 2015 the City of Newark was notified by the New Jersey Department of Transportation (NJDOT) that said construction grant funds and construction management and inspection services for the Broad Street and South Street, and Broad Street and Tichenor Street/Lincoln Park Project that were previously accepted by Resolution 7R4-C, have been adjusted to the following amounts:

WHEREAS, on January 6, 2016, the City of Newark was further notified by the New Jersey Department of Transportation (NJDOT) that it would receive an additional $1,199,475.00 in construction grant funding for the Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project, which amounts to a total grant amount of $2,505,107.00, bringing the total program resources for the Broad Street Projects to $2,662,843.00; and
WHEREAS, the revised and combined grant awards for the projects are as follows:

WHEREAS, no municipal funds are required for receipt or acceptance of this grant award; and
WHEREAS, upon notification of final authorization of these projects from NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant/project agreements to the Corporation Counsel and the Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R4-C, adopted June 24, 2014, is hereby amended to reflect the adjusted grant amount for construction costs in the amount of $1,305,632.00 and construction management and inspection services in the amount of $157,736.00, for the Broad Street and South Street, and Broad Street and Tichenor Street/Lincoln Park Project, which amounts to a grand total of $1,463,368.00 (a copy of the letter revising the grant amount is attached hereto and made a part hereof).
2. The additional grant award made by the NJDOT on January 6, 2016 in the amount of $1,199,475.00, for construction of the Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project, which amounts to total construction grant funds of $2,505,107.00 and construction management and inspection services of $157,736.00 for total program resources of $2,662,843.00, from the New Jersey Department of Transportation is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
3. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $2,505,107.00 and construction management and inspection services in the amount of $157,736.00 for total program resources of $2,662,843.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project.
4. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreements and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
5. No municipal funds are required for the receipt or acceptance of the construction grant award of $2,505,107.00 and construction management services in the amount of $157,736.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project.
6. The Director of the Department of Engineering shall file a fully-executed copy of the letter from the NJDOT adjusting the construction grant award authorized by Resolution 7R4-C, adopted June 24, 2014, as well as the award letter for the construction grant in the amount of $1,199,475.00, any final authorization letters and grant/project agreements in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the City of Newark, Department of Engineering to: (1) amend Resolution 7R4-C, adopted June 24, 2014, to reflect an adjusted grant amount in the amount of $1,305,632.00 and construction management and inspection services in the amount of $157,736.00 for the Broad Street and South Street, and Broad Street and Tichenor Street/Lincoln Park Project, which amounts to a grand total of $1,463,368.00; and (2) accept additional grant funding in the amount of $1,199,475.00 and ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the grand total amount of $2,505,107.00 and construction management and inspection services in the amount of $157,736.00, bringing total program resources to $2,662,843.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project. No municipal funds are required for receipt or acceptance of this grant award.
