WHEREAS, on June 17, 2015, the Municipal Council adopted Resolution 7R3-d and authorized the Mayor and/or his designee, the Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into a First Amended Redevelopment Grant Agreement with Babyland Family Services, Inc., 755 South Orange Avenue, Newark, New Jersey 07106, to increase the Redevelopment Grant Agreement amount from $150,000.00 to $200,000.00 and to extend the Grant Agreement expiration period to December 31, 2015, to allow the recipient ample time to complete the rehabilitation to 767 South Orange Avenue, Block 4207, Lot 13, West Ward; and
WHEREAS, due to unforeseen circumstances with respect to rehabilitating the property, the Mayor and or his designee, the Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development seeks authorization to enter into and execute a Second Amended Redevelopment Grant Agreement with Babyland Services, Inc., to extend the contract expiration period from December 31, 2015 to June 30, 2016 to allow the recipient to complete the physical rehabilitation to 767 South Orange Avenue; and
WHEREAS, language contained in Resolution 7R3-c, adopted February 20, 2013, in the First Amended Redevelopment Grant Agreement, Resolution 7R3-d, adopted June 17, 2015 shall remain in full force and effect with the exception of the Redevelopment Grant Agreement’s contract expiration period; and
WHEREAS, the Second Amended Redevelopment Grant Agreement contract expiration period of December 312015 is hereby ratified from June 30, 2015to date of adoption of this authorizing Resolution; and
WHEREAS, the Second Amended Redevelopment Agreement shall remain in compliance with the New Jersey Local Public Contracts Law, (N.J.S.A. 40:11-1 et seq.); and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to enter into and execute a Second Amended Redevelopment Grant Agreement in the form attached hereto, with Babyland Family Services, Inc., 755 South Orange Avenue, Newark, New Jersey 07106, to extend the expiration period from December 31, 2015 through June 30, 2016, which will allow the recipient to complete the physical rehabilitation to 767 Orange Avenue, Newark, New Jersey 07106, , Block 4207, Lot 13, West Ward.
2. The Second Amended Redevelopment Grant Agreement is hereby ratified from December 31, 2015 to the date of adoption of this authorizing resolution
3. A copy of this resolution and a fully executed Second Amended Redevelopment Grant Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
4. This project does not require the use of additional funds and all other terms and conditions contained in Resolution 7R3-c, adopted February 20, 2013, and 7R3-d, adopted June 17, 2015, shall remain in full effect.
STATEMENT
Resolution ratifying and authorizing the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development on behalf of the Department of Administration to enter into and execute a Second Amended Redevelopment Grant Agreement (“Second Amendment”) with Babyland Family Services, Inc., 755 South Orange Avenue, Newark, New Jersey 07106, for the purpose of extending the Redevelopment Grant Agreement’s expiration period from December 31, 2015 to June 30, 2016 to allow the recipient to complete the project at 767 South Orange Avenue, Newark, New Jersey.
