   WHEREAS, the City of Newark has a need to provide Animal Shelter Management Services for its injured, trapped and sick animals and animals whose lives are endangered or animals that are a danger to human beings; and

                     

                     WHEREAS, the City of Newark desires to provide animal control services in order to protect the health, safety and welfare of the citizens of the City of Newark pursuant to N.J.S.A. 40:48-5.1; and

                     

                     WHEREAS, the Department of Health and Community Wellness, entered into a contract with Associated Humane Societies, Inc., pursuant to Resolution 7R2-a 052015, to provide animal control services in the City of Newark, for the period February 1, 2015 through January 31, 2016, with an option to renew for four (4) additional one (1) year contracts for 2017, 2018, 2019 and 2020; and

 

 WHEREAS, the City of Newark desires to exercise the option to renew the contract for the period of February 1, 2016 through January 31, 2017,  in an amount not to exceed Six Hundred Seventy-Five Thousand Dollars and Zero Cents ($675,000.00); and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.5(c), this contract is subject to the availability and appropriation of sufficient funds annually.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, is hereby authorized to exercise its option to renew and execute a contract with Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the contract period of February 1, 2016 through January 31, 2017, in an amount not to exceed Six Hundred Seventy-Five Thousand Dollars and Zero Cents ($675,000.00), for provision of animal control services in the City of Newark, with three (3) one year options to renew, all other terms and conditions of the contract remain the same.

 

2.                     The contract is ratified from February 1, 2016 to the date of adoption.

 

3.                     The contract is awarded as an open-end contract pursuant to N.J.A.C. 5:30-5.5(b)(2). A certification of funds shall be executed each time services are used and charged against this contract.

 

4.                     Attached hereto is a partial Certification of Funds in the amount $165,881.00, which shall be charged to Business Unit 011; Dept. ID 120; Division/Proj. 1203; Account #95920; Budget Ref: B2016. This states that there are available legally appropriated funds for the purpose set forth hereinabove.

 

5.                     Pursuant to N.J.A.C. 5:30-5.5(c), this contract is subject to the availability and appropriations of sufficient funds annually.

 

6.                     Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Health and Community Wellness shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Health and Community Wellness beyond the extent to which monies are available.

 

7.                     A copy of the executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.

 

8.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the
State Comptroller dated May 7, 2008.

 

STATEMENT:

 

Resolution ratifying and authorizing the Mayor and/or his designee, the Director of the Department of  Health and Community Wellness, to exercise the option to renew and execute an open ended contract with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the contract period of February 1, 2016 through January 31, 2017, in an  amount not to exceed Six Hundred Seventy-Five Thousand Dollars and Zero Cents ($675,000.00), for provision of animal control services in the City of Newark, with three (3) one year options to renew, all other terms and conditions remain the same.
