WHEREAS, the City of Newark adopted Resolution 7R1-b on November 17, 2014 awarding a contract with Scubel, LLC, 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey 08816, found to be in the best interest of the City of Newark to accept; and
WHEREAS, the contract was awarded with the option to renew and/or extend for an additional term not to exceed one (1) year, subject to approval and authorization by the Newark Municipal Council; and
WHEREAS, it is the intention of the Administration through the Office of Management and Budget (OMB) to exercise the option to renew and execute the contract with Scubel LLC to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation in the amount not to exceed $1,000,000.00, for the period commencing October 17, 2015 and terminating on October 16, 2016; and
WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a fair and open Contract pursuant to the State Pay-to-Play Law N.J.S.A. 19:44A-20.5; and
WHEREAS, pursuant to the Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd), such a contract is essential for the provision or performance of goods or services for System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation; and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter “Pay-to-Play Executive Order”), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract; and
WHEREAS, the Director of Finance has certified the partial availability of funds in the amount of $200,000.00 with a Certification of Funds from Implementation of Enterprise Business Solutions: Business UnitNW011, Department Id. 200, Division/Proj. 2001, Account# 96700 is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Business Administrator, through the Office of Management and Budget, (OMB) are hereby authorized to exercise the option to renew and enter into a contract with Scubel LLC, 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey 08816, to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation for the City of Newark, in an amount not to exceed $1,000,000.00, for the period commencing October 17, 2015 and terminating on October 16, 2016.
2. The Municipal Council hereby ratifies its authorization of a contract between the City of Newark and Scubel, LLC, for the period commencing October 17, 2015 through the date of adoption of this authorizing resolution.
3. Attached hereto is a partial Certification of Funds in the amount of $200,000.00 from Implementation of Enterprise Business Solutions: Business Unit NW011, Department/Id 200, Division/Proj. 2001, and Account# 96700, which states that there are available legally appropriated funds for the purpose set forth hereinabove. Additional funds are contingent upon appropriation as required by N.J.A.C. 5:30-5.5(c) and pursuant to N.J.A.C 5:30-5.5(d) (2). The Comptroller’s Certification shall be filed along with the original resolution in the Office of the City Clerk.
4. This contract is being awarded pursuant to the fair and open procedures of the State Pay-To-Play Law (N.J.S.A 19:44A-20.5) and pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd), as it is for System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation for the City of Newark and is in compliance with Newark Executive Order MEO-07-0001, effective March 31, 2007.
5. There shall be no amendments or changes to this contract without approval of the Newark Municipal Council.
6. There shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16.
7. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of the Office of Management and Budget.
8. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
9. If required by State Law, the City Clerk shall provide the appropriate notice of award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008

This resolution ratifies and authorizes the Mayor and/or his designees, Business Administrator and/or the Director of the Office of Management and Budget (OMB) to enter into a contract with Scubel LLC, 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey 08816, to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation for the City of Newark, in an amount not to exceed $1,000,000.00, commencing October 17, 2015 and terminating on October 16, 2016. This contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A 19:44A-20.5) and pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd), as it is for System Support, Maintenance and Enhancement for an existing Licensed Oracle/PeopleSoft Enterprise System Implementation for the City of Newark.
