WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and

WHEREAS, on April 1, 2014 the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2015-2016 solicitation of the Local Safety and High Risk Rural Roads Program; and

WHEREAS, on May 27, 2014, the City of Newark, Department of Engineering submitted FY 2015-2016 Local Safety Program Proposals to the NJTPA requesting grant funding in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and requesting grant funding in the amount of $504,394.55 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements; and

WHEREAS, as a result of this request, the City of Newark was notified on October 27, 2014 by the NJTPA that the NJTPA Board of Trustees had approved funding through the FY 2015-2016 Local Safety Program for the Bergen Street Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $902,964.00 and the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $504,394.00; and

WHEREAS, the City must execute a grant agreement with the NJTPA in order to obtain the grant award with no municipal funds required for receipt or acceptance of this grant award; and

WHEREAS, upon notification of final authorization of this projects from NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant/project agreement to the Corporation Counsel and the Business Administrator for review, approval and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit a FY 2015-2016 Local Safety Program proposals to the North Jersey Transportation Planning Authority (NJTPA) for the Bergen Street Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $902,964.00 and the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $504,394.55 (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of these FY 2015-2016 Local Safety Program proposals from the date of submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and $504,394.00 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements from the New Jersey Department of Transportation is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant awards in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and $504,394.00 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements.

5. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Director of the Department of Engineering shall file a fully-executed copy of the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.

STATEMENT

This resolution ratifies and authorizes the actions taken by the City of Newark, Department of Engineering, to submit the FY 2015-2016 Local Safety Program proposals to the North Jersey Transportation Planning Authority (NJTPA) requesting grant funding, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and $504,394.00 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements from the North Jersey Transportation Planning Authority (NJTPA). No municipal funds are required for receipt or acceptance of this grant award.
