WHEREAS, on April 9, 2015, the City of Newark, through its Supervising Procurement Specialist, advertised to solicit bids for contractor(s) to provide, Street Sweeper, Single Engine Hydrostatic Pure Vacuum (Lease), to the Department of Neighborhood and Recreational Services; and
WHEREAS, the Division of Central Purchasing distributed seven (7) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on April 23, 2015, no bids were accepted due to a need to revise the specifications in response to valid bidder questions; and
WHEREAS, on May 29, 2015, the City of Newark through its Supervising Procurement Specialist, re-advertised to solicit bids for contractor(s) to provide, Street Sweeper, Single Engine Hydrostatic Pure Vacuum (Lease), to the Department of Neighborhood and Recreational Services; and
WHEREAS, the Division of Central Purchasing distributed seven (7) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on June 18, 2015, the Division of Central Purchasing received two (2) bids in response to this advertisement; and
WHEREAS, the Department of Neighborhood and Recreational Services recommends that an award be made to Northeast Sweepers, the lowest responsive and responsible bidder; and
WHEREAS, the Supervising Procurement Specialist, concurs with the recommendation of an award being made to Northeast Sweepers, the lowest responsive and responsible bidder; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A.40A:11-1, et seq., meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into a contract with Northeast Sweepers, 143 Valley Street, Belleville, New Jersey 07109 to lease twelve (12) Street Sweepers, Single Engine Hydrostatic Pure Vacuum to the City, whose bid was received on the advertised due date and determined to be the lowest responsive responsible bidder, in accordance with the bid specifications. The term of the contract will be established for a five (5) year lease, pursuant to N.J.S.A.40A:11-15(7).
2. This contract shall not exceed $803,129.76 per year for a total of $4,015,648.80 for five (5) years, and upon completion of the five year lease agreement, the City will have the option to purchase the sweepers for the amount of $1.00 per unit.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2015 and subsequent years are contingent upon appropriations; pursuant to N.J.A.C. 5:30-5.5.
5. Funds for expenditures under this lease shall be certified as needed pursuant to N.J.A.C. 5:30-5. A partial certification for two (2) months have been provided from 2015 budget to commence, in the amount of $133,854.96, Certification #15-NRS531 - Fund NW011, Dept.ID 160, Div/Project 1604, Account # 71950, B2015. This contract shall not exceed $803,129.76 per year for a total amount of $4,015,648.80 for five (5) years.
6. Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the City shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the City of Newark beyond the extent to which monies are available.
7. The Supervising Procurement Specialist shall file a duly executed copy of the contract in the Office of the City Clerk.
8. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, to enter into a contract with Northeast Sweepers, 143 Valley Street, Belleville, New Jersey 07109 to lease twelve (12) Street Sweepers, Single Engine Hydrostatic Pure Vacuum at a cost not to exceed $803,129.76 per year for a total of $4,015,648.80 for five (5) years. At the end of the five year lease agreement, the City will have the option to purchase the sweepers for the amount of $1.00 per unit.
