WHEREAS, on May 19, 2015, the City of Newark, through its former Purchasing Director, advertised to solicit bids for a contract to provide the City of Newark Bus Services, Transportation/NRS (Special Events and Activities, Out of State and Local Trips) for the Department of Neighborhood and Recreational Services, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing distributed twelve (12) bid proposal packages to prospective vendors following the May 19, 2016 advertisement; and
WHEREAS, on June 4, 2015, the Division of Central Purchasing received four (4) bids in response to this advertisement; and
WHEREAS, the Director of the Department of Neighborhood and Recreational Services reviewed the bids and recommended that a multiple line item contract be awarded to responsible, responsive bidders,(1) Villani Bus Company, (2) Camptown Bus Lines, Inc. and (3) Jordan Bus Service, Inc., based upon the lowest price per item bid by the respective vendors; and
WHEREAS, the former Purchasing Director reviewed and evaluated the bids and recommended that a multiple line item contract be awarded to responsible, responsive bidders, 1.) Villani Bus Company, 2.) Camptown Bus Lines, Inc. and 3.) Jordan Bus Service, Inc., based upon the lowest price per item bid by the respective vendors; and
WHEREAS, Thereafter, based upon ambiguities in the submitted bids in accordance with the specifications, a contract was not awarded to the vendors for the provision of Bus Services, Transportation/NRS (Special Events and Activities, Out of State and Local Trips) as recommended; and
WHEREAS, on November 24, 2015, the City of Newark, through its Supervising Procurement Specialist, re-advertised to solicit bids for a contract to provide to the City of Newark Bus Services- Transportation/NRS (Special Events and Activities, out of State and Local Trips), for the Department of Neighborhood and Recreational Services, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing distributed twelve (12) bid proposal packages to prospective vendors following the November 24, 2015 re-advertisement, and
WHEREAS, on December 17, 2015, the Division of Central Purchasing received three (3) bids in response to this re-advertisement; and
WHEREAS, the Director of the Department of Neighborhood and Recreational Services reviewed the bids and recommended that a multiple line item contract be awarded to responsible responsive bidders, 1.) Villani Bus Company, and 2.) Camptown Bus Lines, Inc. based upon the lowest price per item bid by the respective vendors; and
WHEREAS, pursuant to N.J.S.A. 40A: 11-24, the vendors agreed to hold their prices until such time as a contract is made; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1, et seq. meet the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into a contract with 1.) Villani Bus Company, 811 East Linden Avenue, Linden, New Jersey, 07036, and 2.) Camptown Bus Lines, Inc., 126-140 Frelinghuysen Avenue, Newark, New Jersey 07114, to provide to the City of Newark Bus Services- Transportation/NRS (Special Events and Activities, Out of State and Local Trips), for the Department of Neighborhood and Recreational Services, based upon the lowest, line item pricing of each vendor per their respective price schedules for year one (1) and year two (2), as said vendors were determined to be the lowest responsive responsible bidders in accordance with the bid specifications and their respective bids were received on the above, re-advertised due date. The term of the contract will be for two (2) years pursuant to N.J.S.A. 40A:11-3.
2. There shall be no amendments or changes to this contract without the approval of the Municipal Council by resolution.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16. Pursuant to N.J.A.C. 5:30-5.5(d), funds for 2016 and subsequent years are contingent upon appropriation.
4. This is an open-ended contract to be used as needed during the two year term. Thus, as required by N.J.A.C. 5:30-5.5(b)(2), for any and all expenditures against this contract, each time an order is placed, a certification of the availability of sufficient funds covering the amount of the service shall be executed before contractual liability is incurred for account code lines NW011, 160, 71810, B2016- Neighborhood and Recreational Services. This contract shall not exceed the total of Two Hundred Fifty Thousand Dollars and Zero Cents ($250,000.00) for a two (2) year term, for both vendors, collectively.
5. The Supervising Procurement Specialist shall forthwith file a duly executed copy of this contract in the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, to enter into a contract with Villani Bus Company and Camptown Bus Lines, Inc., to provide to the City of Newark, Bus Service- Transportation/NRS (Special Events and Activities, Out of State and Local Trips), for the Department of Neighborhood and Recreational Services) at a cost not to exceed Two Hundred and Fifty Thousand Dollars and Zero Cents ($250,000.00) for a two (2) year term, for both vendors, collectively.
