WHEREAS, the City of Newark applied for and obtained a one million dollar and zero cents ($1,000,000.00) Revolving Loan Fund Grant from the United States Environmental Protection Agency (“EPA”) to, among other things, fund marketing and outreach, management, underwriting and loans/sub-grants relating to the cleanup of Brownfield Sites located within the City; and

 

WHEREAS, as a result of the above application, the City was awarded the grant funds pursuant to Resolution 7R3-h, adopted on February 3, 2010, accepted said grant funds and entered into a grant agreement with the EPA; and

 

                     WHEREAS, a portion of the EPA Revolving Loan Fund (“RLF”) Program provides for funding in the form of sub-grants that may be made available by the City to not-for-profit entities in support of conducting environmental cleanup activities at qualifying Brownfield properties located within the City of Newark; and

 

WHEREAS, the Urban League of Essex County (“ULEC”), a not-for-profit entity, owns and manages a Child Development Center at a location identified on the City’s official Tax Map as 494-504 Central Avenue, Block 1829, Lot 3; and

 

WHEREAS, ULEC is required by the New Jersey Department of Environmental Protection (“NJDEP”) to perform environmental cleanup activities at the property; and

 

WHEREAS, the EPA reviewed information regarding ULEC’s Child Development Center and provided notification on July 27, 2012 that the site was approved for purposes of qualifying for the City’s RLF Program; and

 

                     WHEREAS, pursuant to Resolution 7R3-e, adopted on December 5, 2012 the City entered into a sub-grant agreement with ULEC for an amount of up to One Hundred Nine Thousand Eight Hundred Twenty Seven Dollars and Zero Cents ($109,827.00) to permit ULEC to  conduct cleanup activities at 494-504 Central Avenue to fulfill the NJDEP cleanup requirements; and

 

                     WHEREAS,  ULEC encountered additional contamination issues that NJDEP determined are required to be addressed and is therefore in need of additional funding to complete the cleanup requirements; and 

 

                     WHEREAS, the City has additional EPA RLF monies in the amount of Ninety Thousand One Hundred Seventy Three Dollars and Zero Cents ($90,173.00) which can be allocated as supplemental funding for the ULEC cleanup activities;

 

WHEREAS, the previous sub-grant agreement with ULEC adopted December 5, 2012 authorized by Resolution 7R3-e has since expired; and

 

WHEREAS, the City wishes to enter into another sub-grant agreement with ULEC in the amount not to exceed Ninety Thousand One Hundred Seventy Three Dollars and Zero Cents ($90,173.00) to address contamination issues that NJDEP has required to be addressed.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Sub-grant Agreement, in the form attached hereto, with the Urban League of Essex County (“ULEC”), 508 Central Avenue, Newark, New Jersey 07107, for a sum not to exceed an additional Ninety Thousand One Hundred Seventy Three Dollars and Zero Cents ($90,173.00), to permit the ULEC to continue with conducting eligible environmental cleanup activities at their  Childhood Development Center, 494-504 Central Avenue, Block 1829, Lot 3.

 

2.                     The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a copy of the fully executed Sub-grant Agreement with ULEC with the Office of the City Clerk. 

 

3.                     Attached hereto is the Certifications of Funds from the Director of Finance of the City of Newark in the amount of $90,173.00 which states: 1) that there are sufficient funds for the purpose set forth hereinabove and 2) that the line appropriation of the official budget which shall be charged is Account# 72090, Business Unit NW051, Depart./ID G10 Div/Proj. D10N0, Budget Ref. B2010.

 

4.                     The contract term is 365 days from the issuance of the Notice to Proceed.

 

5.                     Upon execution of said agreement and filing thereof, the City shall be authorized to take all actions necessary to comply with the EPA program, including but not limited to disbursement of sub-grant funds, overseeing the ULEC cleanup activities, and effectuating documents regarding same. 

 

6.                     This resolution shall take effect immediately.

 

 

STATEMENT

 

Resolution authorizing the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute an Sub-grant Agreement with the Urban League of Essex County (“ULEC”), 508 Central Avenue, Newark, New Jersey 07107, for a sum not to exceed Ninety Thousand One Hundred Seventy Three Dollars and Zero Cents ($90,173.00), to permit the ULEC to continue with conducting eligible environmental cleanup activities at their Childhood Development Center, 494-504 Central Avenue, Block 1829, Lot 3 (West Ward). The contract term is 365 days from the issuance of the Notice to Proceed.  Sub-grant funds are to come from the City’s existing United States Environmental Protection Agency Revolving Loan Fund Grant.
