WHEREAS,  the City of Newark receives Transitional Aid from the State of New Jersey as it has been determined by the Director of the Division of Local Government Services to be a municipality in serious financial distress; and

                     

WHEREAS, the City is constantly looking for additional sources of revenue and creative ways to bring income into the City; and

                     

WHEREAS, the City, through the Department of Neighborhood and Recreational Services is desirous of facilitating a one-day outdoor City outing, open to all Newark residents, to provide families with food and refreshments, games, rides, recreation and entertainment in a wholesome and nurturing environment (“Celebrate Newark Families Day with the Mayor and the Newark Municipal Council” or “Newark Family Day”); and

                     

WHEREAS, the City, through the Department of Neighborhood and Recreational Services seeks to both offset the cost of Newark Family Day, and generate revenue by charging and collecting a reasonable fee per adult and child (ages twelve years and older) for the one-day event; and

                     

WHEREAS, N.J.S.A. 40:61-4 provides that a municipality in control of any playground or place of public resort and recreation of any municipality may hold outdoor activities, games and contests in a place of public resort or recreation, and charge and collect reasonable admission fees for entrance therein, in order to generate funds for improving, maintaining and policing of the City’s playgrounds, places of public resort and recreation; and

                     

WHEREAS, revenue generated from Newark Family Day will be used for improvements, maintenance and policing of the City’s playgrounds, places of public resort and recreation; and

                     

WHEREAS, the Department of Neighborhood and Recreational Services has found an event facility, Forest Lodge Catering, LLC, 11 Reinman Road, Warren, New Jersey 07059, which can accommodate and provide food and refreshments for the anticipated large group of Newark residents and their families, offers a wide variety of recreational and entertainment activities, and for which the City will have exclusive use; and

                     

WHEREAS, the Mayor, Director of the Department of Neighborhood and Recreational Services and the Municipal Council believe it is in the best interests of the City to enter into a contract with Forest Lodge Catering, LLC, 11 Reinman Road, Warren, New Jersey 07059, in an amount not to exceed Ninety Thousand Dollars and Zero Cents ($90,000.00) for the use and enjoyment of the facility on Saturday, July 9, 2016, to host Newark Family Day.                      

                     

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to enter into and execute a contract in an amount not to exceed Ninety Thousand Dollars and Zero Cents ($90,000.00), with Forest Lodge Catering, LLC, 11 Reinman Road, Warren, New Jersey 07059, an event facility, to host a one-day City outing on Saturday, July 9, 2016, to provide food and refreshments, games, rides, recreation and entertainment in a wholesome and nurturing environment to all Newark residents and their families (“Celebrate Newark Families Day with the Mayor and the Newark Municipal Council” or “Newark Family Day”).

 

2.                     The contract is ratified from April 2016 to the date of adoption of this resolution. 

 

3.                     A certification of the availability of sufficient funds, as required by N.J.A.C 5:30-5.5(b)(2), shall be executed before liability is incurred under this  contract. 

 

4.                     The executed contract and the Certifications of Funds shall all be filed in the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.

 

5.                     There shall be no amendments or changes to this contract without Municipal Council approval.

 

6.                     There shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, to enter into and execute a contract in an amount not to exceed Ninety Thousand Dollars and Zero Cents ($90,000.00) with Forest Lodge Catering, LLC, 11 Reinman Road, Warren, New Jersey 07059, an event facility, to host a one-day City outing on Saturday, July 9, 2016, to provide food and refreshments, games, rides, recreation and entertainment in a wholesome and nurturing environment to all Newark residents and their families, offsetting the cost of the event, and generating revenue by charging and collecting a reasonable fee per adult and child (ages twelve years and older) for the one-day event.
