WHEREAS, the County of Morris, though the State of New Jersey, Office of Homeland Security and Preparedness without any application required by the City of Newark, through the Urban Area Security Initiative Core City Working Group (UAWG) has procured an Mobile Oxygen Generation System (Trailer), (“the Equipment”) for the City of Newark under the FY13 Urban Area Strategic Initiative (UASI) Grant Program; and

 

WHEREAS, the City of Newark is a Core City within the UASI Region and is eligible for support in statewide planning efforts to ensure adequate evacuation, search and rescue operations and transportation needs as well as life sustaining capabilities during catastrophic events; and

                     

                     WHEREAS, The Newark Office of Emergency Management and Homeland Security and Preparedness (OEM) has entered into a Memorandum of Agreement (MOA) acknowledging the receipt of the equipment purchased by the County of Morris as approved by the New Jersey Office of Homeland Security and Preparedness (NJOHSP) and UASI grant program through UASI funding; and  

 

WHEREAS, the City of Newark wishes to accept this gift pursuant to N.J.S.A. 40A:5-29; and

 

WHEREAS, The Newark Office of Emergency Management and Homeland Security and Preparedness (OEM)   request to accept the Mobile Oxygen Generation System (Trailer),  from the State of New Jersey Office of Homeland Security and Preparedness, in an effort to aid in our strategic direction for the enhancement of response search and rescue, evacuation capability, and life sustaining capacity; and

 

WHEREAS, the purpose of the Mobile Oxygen Generation System (”Oxygen Trailer”)   is to provide oxygen for people in need, as well as refilling personal oxygen tanks during emergencies throughout the City; and

 

WHEREAS, The Oxygen Trailer has an approximate value of $157,411.00; and

 

WHEREAS, the Oxygen Trailer  is 20 feet in length 8 feet wide and, can also refill personal oxygen tanks.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Newark Office of Emergency Management and Homeland Security Preparedness (OEM), are authorized to execute a Memorandum of Agreement (MOA) acknowledging receipt of Homeland Security Grant funded equipment.

 

2.                     This contract is ratified from November 12, 2015 to the date of adoption of this authorizing resolution. 

 

3.                     Pursuant to N.J.S.A. 40A:5-29, the Mayor on behalf of the City of Newark, is authorized to accept the gift from the State of New Jersey, Office of Homeland Security and Preparedness through the Urban Area Security Initiative Core City Working Group (UAWG) for procurement of a Mobile Oxygen Generation System (Trailer) for the City of Newark under the FY13 Urban Area Strategic Initiative (UASI) Grant Program.

 

4.                     The Mayor and the Director of the Office of Emergency Management and Homeland Security and Preparedness (OEM) is authorized to accept the Mobile Oxygen Generation System, from the State of New Jersey Office of Homeland Security and Preparedness.  

 

5.                     The Office of Emergency Management shall file a copy of the executed Agreement and this resolution in the Office of the City Clerk by.    

 

6.                      No municipal funds will be expended in connection with this gift.  No consideration in any form will be provided to The State of New Jersey Office of Homeland Security and Preparedness, nor any of its affiliated and related entities in exchange for this gift.

 

STATEMENT

 

                     This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Newark Office of Emergency Management, to execute a Memorandum of Agreement (MOA) acknowledging receipt of Homeland Security Grant funded equipment and accept the gift of a Mobile Oxygen Generation System (Trailer) from the State of New Jersey Office of Homeland Security and Preparedness which will be provided through the Urban Area Security Initiative Core City Working Group (UAWG).  The equipment has an approximate value of $157,411.00.  No municipal funds will be expended in connection with this MOA.  No consideration in any form will be provided to the State of New Jersey, Office of Homeland Security and Preparedness, or any of its affiliated and related entities in exchange for this gift.
