The Newark Fire Division desires to add 125 more radios to the number of radios that can use the State Radio System, thereby increasing the total number of radios that can use the State Radio System from 275 to 400.

WHEREAS, on or about October 1, 2013, the City of Newark Fire Department entered into a “New Jersey Interoperable Communications System (NJICS) User Agreement” with the New Jersey Office of Information and Technology, 300 Riverview Plaza, P.O. Box 212, Trenton, New Jersey 08625-0212 (“NJICS User Agreement”) (a copy of which is attached hereto and made a part hereof), for the purpose of allowing the Newark Fire Department to use the Statewide 700 MHz, P-25 Trunked Radio System (“State Radio System”) for a period of five (5) years from October 1, 2013, through September 30, 2018; and

 

                     WHEREAS, by Resolution 7R6-a , adopted on June 24, 2014 (a copy of which is attached hereto and made a part hereof), the Municipal Council of the City of Newark authorized and ratified the actions taken by the Mayor or his designee, the Fire Director of the City of Newark, to enter into said NJICS User Agreement; and

 

                     WHEREAS, the NJICS User Agreement allowed 275 Newark Fire Department radios to use the State Radio System; and

 

                     WHEREAS, the Department of Public Safety, Fire Division, desires to add 125 more radios to the number of radios that can use the State Radio System, thereby increasing the total number of radios that can use the State Radio System from 275 to 400; and

 

                     WHEREAS, the Director of the Department of Public Safety recommends that the NJICS User Agreement be amended to increase the total number of radios that can use the State Radio System from 275 to 400 in order to increase the Newark Fire Division’s ability to effectively respond to emergencies and to better protect the safety and welfare of Newark Fire Division personnel and the citizens of the City of Newark; and

 

                     WHEREAS, said increase in the number of radios that can use the State Radio System will increase the “Total fees for twelve month period” as set forth in the NJICS User Agreement from the current $23,375.00 to $34,000.00; and

 

                     WHEREAS, said increase in fees would result in the expected fees under the NJICS User Agreement for the balance of 2016 to increase from approximately $15,583.00 to approximately $22,666.00; and

 

                     WHEREAS, attached hereto and made a part hereof is a partial Certification of Funds from the City of Newark’s Director of Finance in the amount of $22,666.00, indicating that sufficient funds are available in the 2016 Budget for the purpose of meeting the City’s 2016 obligations under the proposed amended NJICS User Agreement.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to enter into and execute an amendment agreement in the form attached hereto amending the “New Jersey Interoperable Communications System (NJICS) User Agreement” with the New Jersey Office of Information and Technology, 300 Riverview Plaza, P.O. Box 212, Trenton, New Jersey 08625-0212, so as to increase the number of Newark Fire Department Radios that can use the State Radio System from 275 radios to 400 radios, thereby increasing the “total fees for twelve month period” under the NJICS User Agreement from $23,375.00 to $34,000.00.

 

2.                     Pursuant to N.J.A.C. 5:30-5.5(d)1(ii) (multi-year contracts), attached hereto and made a part hereof is a partial Certification of Funds from the City of Newark’s Director of Finance in the amount of $23,000.00, indicating that sufficient funds are available in the 2016 Budget under Business Unit NW011, Department I.D. 090, Division/Project 0901, Account # 94130, Budget Ref. B2016, for the purpose of meeting the City’s 2016 obligations under the amended NJICS User Agreement, and which shall be filed along with the original resolution in the Office of the City Clerk.

 

3.                     Certifications of Funds from the City’s 2017 and 2018 annual budgets shall be obtained for the balance of the amended NJICS User Agreement by the Director of Public Safety and shall be filed with the original resolution in the Office of the City Clerk, with each such Certification of Funds being for an amount not less than the total value of all services to be performed by the New Jersey Office of Information and Technology during the respective budget year.

 

4.                     Notwithstanding anything to the contrary herein, the amended NJICS User Agreement shall be subject to the availability and appropriation annually of sufficient funds as may be required to meet the City of Newark’s obligations therein, and shall be subject to immediate termination in the absence thereof with no further obligation by the City of Newark, and the amended NJICS User Agreement shall contain a clause indicating the foregoing.

 

5.                     There shall be no further amendment or change to the NJICS User Agreement without approval by the Newark Municipal Council.

 

6.                     There shall be no advance payment on the amended NJICS User Agreement in accordance with N.J.S.A. 40A:5-16.

 

7.                     A fully executed copy of the amendment agreement shall be filed in the Office of the City Clerk by the Director of Public Safety.

 

STATEMENT

 

This Resolution authorizes the Mayor and/or his designee, the Director of the Department of Public Safety, to enter into and execute an amendment agreement amending the “New Jersey Interoperable Communications System (NJICS) User Agreement” with the New Jersey Office of Information and Technology, 300 Riverview Plaza, P.O. Box 212, Trenton, New Jersey 08625-0212, so as to increase the number of Newark Fire Division Radios that can use the State Radio System from 275 radios to 400 radios, thereby increasing the “total fees for twelve month period” under said agreement from $23,375.00 to $34,000.00.
