WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program, (“State”), provides loans and/or grants to municipal and county governments and grants to non-profit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and

 

WHEREAS, pursuant to Ordinance 6S&Fa(S-2), adopted October 23, 2007, the Municipal Council authorized the appropriation of Eighty Three Million Two Hundred Seventy Six Thousand Three Hundred Dollars and Zero Cents ($83, 276,300.00) for capital improvements, including the Municipal Capital Budget in the amount of Two Million Three Hundred Forty Four Thousand Seven Hundred Twenty Five Dollars and Zero Cents ($2,344,725.00) for the redevelopment and rehabilitation of Jesse Allen Park; and

 

WHEREAS, pursuant to Resolution 7R1-b January 7, 2009, the City of Newark previously obtained from the State matching grant funds in the amount of Five Hundred Thousand Dollars and Zero Cents, ($500,000.00), to fund the following project  GA# 0714 07 042 Jesse Allen Park, located in the City of Newark at 41-57 Avon Avenue, Block 2592, Lot 1; and

 

WHEREAS, also pursuant to Resolution 7R1-b January 7, 2009 and Ordinance 6S&Fa(S-2), the City of Newark’s cash match/local share in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00) for the State’s Five Hundred Thousand Dollar and Zero Cents ($500,000.00) grant was provided from the Municipal Capital Budget’s Two Million Three Hundred Forty Four Thousand Seven Hundred Twenty Five Dollars and Zero Cents ($2,344,725.00) from account #045-007-07C60-94710-B2007; and

 

WHEREAS, the State and the City of Newark intend to increase Green Acres funding by Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00), which will bring the total of the State’s grant to the City of Newark to One Million Three Hundred Fifty Thousand Dollars and Zero Cents ($1,350,000.00); and

 

WHEREAS, the City of Newark has its required matching share of the project in the amount of Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00); and

 

WHEREAS, the funding from the capital improvement appropriation meets the requirements and shall serve as the cash match/local share for matching grant award from the State in the amount of Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00); and

 

WHEREAS, in the event that the State’s funds are less than the total project cost specified herein, the City of Newark has the balance of funding necessary to complete the project; and

 

WHEREAS, the City of Newark agrees to comply with all applicable federal, state and local laws, rules and regulations in its performance of the project; and

 

WHEREAS, the City must execute a grant agreement with the New Jersey Department of Environmental Protection in order to obtain the grant award; and

 

WHEREAS, the Trust for Public Land (“TPL”), a national nonprofit organization dedicated to conserving land for recreation and open space purposes, is partnering with the City of Newark to redevelop Jesse Allen Park through its Parks for People - Newark program and shall play a leadership role in the park’s redevelopment; and

 

WHEREAS, this resolution shall take effect immediately.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The matching grant award in the amount of Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00) from the New Jersey Department of Environmental Protection Green Acres Program is hereby accepted.

 

2.                     The Mayor and/or his designee, the Business Administrator, are hereby authorized to execute grant documents and any amendment thereto as an authorized representative thereunder and as the representative for the City of Newark with the New Jersey Department of Environmental Protection, to receive and expend the matching grant award in the amount of Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00) from the Green Acres Program for the redevelopment and rehabilitation of Jesse Allen Park, 41-57 Avon Avenue, Block 2592, Lot 1, Central Ward.

 

3.                     The cash match/local share for this grant award shall be taken from the Municipal Capital Budget appropriation in the amount of Two Million Three Hundred Forty Four Thousand Seven Hundred Twenty Five Dollars and Zero Cents ($2,344,725.00), authorized on October 23, 2007, pursuant to Ordinance 6S&Fa(S-2), from Account #045-007-07C60-94710-B2007.

 

4.                     A certified copy of this Resolution will be forwarded to the New Jersey Department of Environmental Protection.

 

5.                     The Business Administrator shall file a duly, fully executed copy of the agreement between the City of Newark and the New Jersey Department of Environmental Protection in the Office of the City Clerk.

 

STATEMENT

 

This Resolution authorizes the Mayor and/or his designee, the Business Administrator, to enter into an agreement with, and accept matching grant funds from, the New Jersey Department of Environmental Protection Green Acres Program in the amount of Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00) for the redevelopment and rehabilitation of Jesse Allen Park, 41-57 Avon Avenue, Newark, New Jersey, Block 2592, Lot 1, Central Ward.
