WHEREAS, the City of Newark, Department of Engineering, Division of Public Buildings, is in need of maintenance, custodial (janitorial and germicide) grounds keeping services for all of its municipal buildings, approximately sixty one (61) in total; and

 

WHEREAS, the Division of Central Purchasing solicited bids for the services on or about March 29, 2016 and received and open bids on April 28, 2016; and

 

WHEREAS,                      the Mayor of the City of Newark and Business Administrator

determined it was in the best interests of the City of Newark to reject all bids and substantially revise the specifications; and

 

WHEREAS, on or about August 2015, the competitive contracting statute has been amended by the legislature to include custodial services as a purpose for which competitive contracting may be utilized, N.J.S.A. 40A:11-4.1 (l), maintenance, custodial and grounds keeping services; and

 

WHEREAS, the Mayor and Business Administrator are desirous of procuring these services through the competitive contracting procurement process; and

 

WHEREAS, pursuant to N.J.S.A. 40A: 11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized good or services are desired to be contracted; and

 

WHEREAS, the competitive contracting process shall be administered by the Business Administrator and the Procurement Specialist of the City of Newark pursuant to N.J.S.A. 40A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of N.J.S.A. 40A:11-4.5(e).

 

NOW, THEREFORE, BE IT IS RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council authorizes the Mayor, Business Administrator and/or the Supervising Procurement Specialist to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1 et seq. to procure for the Department of Administration, Department of Engineering, Division of Public Buildings custodial (janitorial and germicide) grounds keeping services for all of its municipal buildings, approximately sixty one (61) in total.

 

2.                     The competitive contracting process shall be administered by the Business Administrator and/or the Supervising Procurement Specialist, pursuant to N.J.S.A. 40A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of subsection (e) of N.J.S.A. 40A:11-4.5.

This resolution authorizes the Mayor, Business Administrator and/or the Supervising Procurement Specialist to use competitive contracting pursuant to N.J.S.A. 40A:11-4.1 et seq. to procure, for the Department of Administration, Department of Engineering, Division of Public Buildings custodial (janitorial and germicide) grounds keeping services for all of its municipal buildings, approximately sixty one (61) in total.
