WHEREAS, this cooperative agreement is entered into between the State of New Jersey, Division of Criminal Justice, Office of the Insurance Fraud Prosecutor (hereinafter referred to as OIFP), the Newark Police Department (hereinafter referred to as NPD), and the Essex County Prosecutor’s Office (hereinafter referred to as ECPO), for the purpose of establishing a cooperative relationship between the named law enforcement agencies (hereafter referred to collectively as the Parties or Task Force), involving in the detection and adjudication of automobile thefts and carjacking or reported as stolen, law enforcement agencies in this State must make the threshold determination of whether there was a legitimate automobile theft or whether the automobile was reported stolen for the purpose when, in fact the automobile was not stolen; and
WHEREAS, the OIFP has provided $100,000.00 to fund the cost associated with the operation of a NPD helicopter for the first four hours of each shift for which NPD Officers and a Supervisor will be working the initiative. The Helicopter will act as an additional deterrent and law enforcement presence, and assist in vehicular and suspect pursuits, apprehensions and recoveries of stolen vehicles; and
WHEREAS, this grant shall fund the cost associated with the operation of a Newark Police Department Helicopter for the first four hours of each shift for which NPD Officers and a Supervisor will be working on this initiative, additionally the OIFP has provided $300.000.00 to fund the cost associated with the operation of (8) eight NPD officers and (1) Supervisor, all on overtime, to work the overtime initiative during the shifts deemed appropriate by the task force, which has been determined to be three (3) shifts; and
WHEREAS, the OIFP shall assist the NPD in carrying out automobile theft and carjacking related prevention and law enforcement activities by sending personnel of the OIFP on patrol with the power to arrest in the NPD’s jurisdiction; and
WHEREAS, the City of Newark, is committed to ensuring public safety through the coordination of resources and spirit of cooperation that exists between the law enforcement agencies signatory to this cooperative agreement; and
WHEREAS, the OIFP will provide funds necessary to pay for (8) eight NPD Officers Newark Police Department wishes to accept the funds from the Office of the Insurance Fraud Prosecutor (OIFP) pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, the Office of The Insurance Fraud Prosecutor (OIFP) fully understands and agrees that it is not entitled to receive any direct benefit from the City of Newark in exchange for its funds and shall receive only the indirect benefit of furthering its mission of making the City safer through its inter-agency cooperative agreement; and
WHEREAS, the task force agrees that based upon continuity, prior experience and efficiency of operations, the Officers and Detectives assigned to this initiative shall be, to the extent practicable and possible, the same personnel each week.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees the Business Administrator and the Newark Police Director are hereby authorized pursuant to N.J.S.A. 40A:5-29 to accept a funds from the State of New Jersey Division of Criminal Justice - Office of the Insurance Fraud Prosecutor (OIFP), located at 25 Market Street, P. O. Box 094, Trenton, New Jersey 08625, in the amount of $400,000.00.
2. The Municipal Council ratifies the acceptance of the funds from August 15, 2014 until terminated by any party or until the Newark Police Department has incurred $400,000.00.
3. No municipal funds will be expended in the acceptance of this fund.
4. A fully-executed copy of the funds award letter shall be filed in the Office of the City Clerk by the Police Director.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designees the Business Administrator and the Police Director to accept the funds from the State of New Jersey Division of Criminal Justice - Office of the Insurance Fraud Prosecutor (OIFP) of four hundred thousand dollars ($400,000.00).
