 WHEREAS, on September 26, 2016 Emergency Contract E2016-13 was entered into for the Emergency Recycling (Curbside Pick-Up) in the amount of $400,000.00 with Joseph Smentkowski Inc., 3 New York Ave, Jersey City, New Jersey 07307, for a term of September 1, 2016 through November 30, 2016; and

 

WHEREAS, on December 6, 2016, the City publically bid a contract for Emergency Recycling (Curbside Pick-Up).  Two (2) bids were received on February 2, 2017 and are currently being reviewed, but a contract has not yet been awarded; and

 

WHEREAS, the term for Emergency Contract E2016-13 expired on November 30, 2016 and the Department of Public Works, formerly known as the Department of Neighborhood and Recreational Services, requests an extension of Emergency Contract E2016-13, with Joseph Smentkowski Inc., 3 New York Ave, Jersey City, New Jersey 07307 to continue providing recycling (curbside) services, for a period of five months, for an amended term of December 1, 2016 through April 30, 2017, or until a contract is awarded but no later than December 31, 2017; and

 

WHEREAS, the areas of recycling (curbside) will include all wards; and

 

WHEREAS, it is imperative that we pick-up curbside recycling; not doing so will promote unsanitary living conditions and filthy streets, affecting the health, safety, and welfare of the citizens of Newark; and

                           

WHEREAS, the monthly cost for recycling (curbside) is $133,000.00, the five (5) months total will be $665,000.00; and

 

WHEREAS, pursuant to N.J.A.C 5:34-6.1(a), notwithstanding a good faith effort by the contracting unit to award a contract, the need has arisen for an emergency contract for recycling, curbside, all wards; and

 

WHEREAS, City Ordinance 6PSF-e adopted April 4, 2011, Article 2:5-13.2(E)(1)(b), (c). states that Emergency Contracts shall not be for a period in excess of one hundred fifty (150) days and no extensions of emergency contracts shall be permitted without authorization by the Municipal Council by resolution.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.     The Mayor and/or his designees, the Business Administrator and the Director of Public Works, formerly known as the Director of Neighborhood and Recreational Services, are hereby ratified and authorized to execute an extension of Emergency Contract E2016-13, with Joseph Smentkowski Inc., 3 New York Ave, Jersey City, New Jersey 07307, to continue providing recycling (curbside) services, for all wards; at a cost not to exceed $665,000.00.

 

2.                     This extension will allow the continuation of contract E2016-13, which was for the term of September 1, 2016 through November 30, 2016.

 

3.                     Upon authorization and ratification, the term of this extension will be from December 1, 2016 through April 30, 2017, or until a contract is awarded (whichever comes first), but in no event no later than December 31, 2017.

 

4.                     There are sufficient funds available for the purpose set forth hereinabove in Fund NW011, Department 060, Division/Proj. 0605, Account# 71940, for fiscal years B2016 and B2017.

 

5.                     A copy of said contract shall be filed with the Office of the City Clerk by the Business Administrator, for the City of Newark.   

 

STATEMENT

 

This resolution ratifies and authorizes the Business Administrator and/or his designee, the Director of Public Works, formerly known as the Director of Neighborhood and Recreational Services, to extend contract E2016-13 for five (5) months from December 1, 2016 through April 30, 2017, or until a contract is awarded (whichever comes first), but in no event no later than December 31, 2017. This emergency contract with Joseph Smentkowski Inc., 3 New York Ave, Jersey City, New Jersey 07307, provides recycling (curbside) services, in the amount not to exceed $665,000.00 ($133,000.00 for 5 months).
