WHEREAS, the United States Department of Housing and Urban Development (HUD) as authorized by the MCKINNEY-VENTO HOMELESS ASSISTANCE ACT (The Act) pursuant to 42 U.S.C. 11301 et seq., seeks to assist chronically homeless individuals with disabilities, by providing them with stable housing through rental subsidies, coupled with supportive services through local service providers; and

WHEREAS, the Mayor and the Municipal Council find and declare that continued efforts are required to provide decent and affordable housing for low and moderate income residents, including those with special needs; and

WHEREAS, the City of Newark is committed to ending homelessness by working with social service providers, to create permanent supportive housing opportunities for homeless residents; and

WHEREAS, on or about October 6, 2011, on behalf of the City of Newark, the Office of the Mayor submitted an application to HUD requesting grant funding in the amount of $647,400.00 from the Shelter Plus Care program to provide rental subsidies for post-incarcerated homeless City residents with disabilities (see Application attached hereto and made a part hereof); and

WHEREAS, on or about July 13, 2012, the City of Newark was awarded a grant in the amount of $647,400.00 from HUD for Shelter Plus Care vouchers to subsidize rental payments for post-incarcerated homeless individuals with disabilities (see Award Letter attached hereto and made a part hereof); and

WHEREAS, on or about August 21, 2012, the Mayor executed a grant agreement governing said award (see Grant Agreement attached hereto and made a part hereof); and

WHEREAS, the Mayor and Assistant Business Administrator wish to accept the grant award; and

WHEREAS, the Shelter Plus Care grant was awarded for a five-year period commencing on April 4, 2012 and terminating on April 3, 2017; and

WHEREAS, no matching municipal funds are required for the acceptance of the grant award; and

WHEREAS, no commitment of City resources or staff is required for acceptance of the grant award; and

WHEREAS, the grant funds will be utilized for rental subsidies, coupled with supportive services for post-incarcerated homeless City residents with disabilities.


NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Assistant Business Administrator, are hereby authorized to submit an application, as attached, to the United States Department of Housing & Urban Development, requesting grant funding in the amount of $647,400.00 from Shelter Plus Care Program, for rental subsidies to post-incarcerated homeless individuals with disabilities.

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $647,400.00 from the United States Department of Housing and Urban Development is hereby accepted.

4. The Mayor and/or his designee, the Assistant Business Administrator, are hereby authorized to enter into and execute a grant agreement with HUD in the form attached hereto as necessary to receive and expend the above-described grant funds.

5. The Municipal Council hereby ratifies its authorization of the execution of the grant agreement from the date of its execution to the date of adoption of this authorizing resolution.

6. The agreement between the City of Newark and HUD is hereby ratified from April 4, 2012 to the date of adoption of this authorizing resolution.

7. No commitment of City resources or staff is required for the receipt or acceptance of the grant funds.

8. No municipal funds are required for receipt or acceptance of this grant award.

9. The Mayor and/or his designee, the Assistant Business Administrator, shall file a fully executed copy of the grant application, the grant award letter and the grant agreement in the Office of the City Clerk.



STATEMENT

This resolution ratifies and authorizes the actions the Mayor and/or his designee, the Assistant Business Administrator, have taken to submit an application for grant funding to the United States Department of Housing and Urban Development for Shelter Plus Care rental subsidies for post-incarcerated homeless individuals with disabilities, and furthermore ratifies and authorizes the Mayor and/or his designee to accept said grant and to enter into and execute an agreement with HUD for the awarded grant funds of $647,400.00 for the period commencing April 4, 2012, and terminating on April 3, 2017. No municipal funds, or expenditure of municipal resources or staff, are required for acceptance of the grant funds.
