WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $1,463,368.00 and $1,199,475.00, bringing the total program resources to $2,662,843.00 ($2,505,107.00 for construction and $157,736.00 for inspection services) for the Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project and no adequate provision has been made in the 2017 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by Resolutions 7R4-d dated September 2, 2015 and 7R4-a dated June 15, 2016, the City of Newark accepted funds from the New Jersey Department of Transportation (NJDOT), in the total amount of $2,662,843.00, to provide for construction of the Broad Street (2-Intersections FY-14), City of Newark, Essex County, STP-7628(103) CON Project (the “Project”); and
WHEREAS, N.J.S.A 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2017 pursuant to N.J.S.A. 40A:4-20 including this resolution total...$45,535,217.18.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, no less than two-thirds of all members thereof affirmatively concurring, that:
1. An emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2017 Budget.
3. A copy of this resolution shall be filed immediately with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This resolution establishes the emergency appropriation in the amount of $2,662,843.00 ($2,505,107.00 for construction and $157,736.00 for inspection services) for Broad Street and South Street, Broad Street and Tichenor Street/ Lincoln Park Project. Funding has been provided by the New Jersey Department of Transportation (NJDOT).
