WHEREAS, the Sustainable Jersey Small Grants Program seeks to support community sustainability initiatives by encouraging local grassroots efforts to improve the quality of life in New Jersey municipalities and schools; and

WHEREAS, the City of Newark (the "City") is eligible for the Sustainable Jersey Small Grants Program as a registered, and participating community under the Sustainable Jersey municipal certification program as authorized by Ordinance 6PSF-e, adopted on August 3, 2016; and

WHEREAS, the City seeks to obtain funding to educate community members about the benefits of stormwater management utilizing green infrastructure practices including but not limited to residential rain garden demonstration projects; and

WHEREAS, the City seeks to leverage the in-kind technical assistance offer made by the Rutgers University Cooperative Extension Water Resources Program, which has secured a private grant from the Surdna Foundation to support green stormwater infrastructure projects in cities across New Jersey, and has committed to providing in-kind services for the implementation of three residential rain gardens in Newark totaling $1,800.00 (One Thousand Eight Hundred Dollars and Zero Cents); and

WHEREAS, the City seeks to leverage the cash matching offered by the Newark Doing Infrastructure Green ("Newark DIG") coalition, which has secured a private grant from the Victoria Foundation totaling $5,000.00 (Five Thousand Dollars and Zero Cents) for the installation of three residential rain gardens in Newark; and

WHEREAS, the City seeks to partner with the NY/NJ Baykeeper, which serves as the fiscal sponsor for the Newark DIG coalition, to purchase rain garden supplies needed for the installation of three residential rain gardens in Newark; and

WHEREAS, the City desires to further the public interest by obtaining funding from the Sustainable Jersey Small Grants Program for the design and delivery of a Quality of Life Summit and the installation of best management practices in green stormwater infrastructure; and

WHEREAS, on February 28, 2017, on behalf of the City, the Business Administrator submitted an application to the Sustainable Jersey Small Grants Program requesting grant funding in the amount of $20,000.00 (Twenty Thousand Dollars and Zero Cents) from the Sustainable Jersey Small Grants Program for the design and delivery of a Quality of Life Summit and the installation of best management practices in green stormwater infrastructure with no City funds required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Business Administrator desires to accept the grant award and execute a grant agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, a copy of the grant agreement shall be submitted to the City Clerk and Acting Corporation Counsel and Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Business Administrator, are hereby authorized to submit an application to the Sustainable Jersey Small Grants Program requesting grant funding in the amount of $20,000.00 (Twenty Thousand Dollars and Zero Cents) for the design and delivery of a Quality of Life Summit and the installation of best management practices in green stormwater infrastructure (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission, February 28, 2017, to the date of adoption of this authorizing resolution.

3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.

4. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute grant documents with the Sustainable Jersey Small Grants Program to receive and expend the grant award for the design and delivery of a Quality of Life Summit and the installation of best management practices in green stormwater infrastructure.

5. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into a Memorandum of Understanding with the Rutgers Cooperative Extension Water Resources Program to receive in-kind technical assistance services for the implementation of three residential rain gardens in Newark totaling $1,800.00 (One Thousand Eight Hundred Dollars and Zero Cents).

6. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into a Memorandum of Understanding with the NY/NJ Baykeeper to coordinate the use of the committed matching funds for the purchase of rain garden supplies needed for the installation of three residential rain gardens in Newark, in the amount of $5,000.00 (Five Thousand Dollars and Zero Cents).

7. Upon notification of the receipt of a grant award in connection with this application, a complete copy of the grant agreement and any associated documents shall be filed with the City Clerk.

8. No municipal funds are required for receipt or acceptance of this grant award.

9. The Business Administrator shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement in the Office of the City Clerk.

STATEMENT

This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to submit an application for, accept, and enter in an agreement for grant funding in the amount of $20,000.00 (Twenty Thousand Dollars and Zero Cents) from the Sustainable Jersey Small Grants Program for the design and delivery of a Quality of Life Summit and the installation of best management practices in green stormwater infrastructure. No municipal funds are required for receipt or acceptance of this grant award.
