WHEREAS, the City of Newark wishes to purchase Evidence Collection Vehicles, from an authorized vendor under Government Service Administration (GSA) Federally-Based Contracts; and

 

WHEREAS, P.L. 110-248, the Local Preparedness Acquisition Act, signed June 26, 2008, authorizes state and local governments to purchase from GSA: alarm and signal systems, facility management systems, firefighting and rescue equipment, law enforcement and security equipment, marine craft and related equipment, special purpose clothing, and related services; and

 

WHEREAS, the goods or services to be purchased through a Federally-Based Contract are not available under existing State contract(s); and

 

WHEREAS,                     the Department of Public Safety, recommends utilization of GSA schedule GS-07F-007DA with Sirchie Acquisition Company, LLC, 612 Gravelly Hollow Road, Medford, New Jersey 08055, to procure Evidence Collection Vehicles; and

 

WHEREAS, Sirchie Acquisition Company, LLC, 612 Gravelly Hollow Road, Medford, New Jersey 08055, is participating in a federal procurement program established by a federal department or agency and is the holder of General Services Administration Contract GS-07F-007DA; and

 

 

WHEREAS, the cost for the purchase of two (2) Evidence Collection Vehicles is not to exceed $54,004.23 each, inclusive of required open market items to complete the functionality of the vehicles, totaling $108,008.46 for two vehicles.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:

 

1.                     The Mayor and or his designee, the Business Administrator and or the Supervising Procurement Specialist are, pursuant to P.L. 110-248, the Local Preparedness Acquisition Act,  hereby authorized to procure two (2) Evidence Collection Vehicles from Sirchie Acquisition Company, LLC, 612 Gravelly Hollow Road, Medford, New Jersey 08055 to be delivered no later than November 30, 2020. 

 

2.                     The cost for the purchase of an Evidence Collection Vehicle is $54,004.23 for each vehicle, inclusive of required open market items to complete the functionality of the vehicles, for a total amount not to exceed $108,008.46. 

 

3.                      There shall be no amendment of this resolution without the approval of the Municipal Council.

 

4.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16.

 

5.                      Funds to procure the Evidence Collection Vehicles are encumbered on Purchase Order #2766, FUND NW026, ACCOUNT 46560, and BUDGET B2017 for $108,008.46. This contract shall not exceed $108,008.46.

 

6.                     This contract complies with New Jersey Delegated Purchase Authorization (DPA) Purchases and Contracts Via Federally-Based Programs, including but not limited to the U.S. General Services Administration (“GSA”).

 

7.                     The Supervising Procurement Specialist has attached hereto a duly executed copy of the GSA contract and the purchase order encumbering the funds to be filed in the Office of the City Clerk.

 

8.      If required by the State Law, the City Clerk shall provide the appropriate notice of the authorization of this purchase, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

STATEMENT

 

Resolution authorizes the Mayor and or his designee, the Business Administrator and/or the Supervising Procurement Specialist, pursuant to P.L. 110-248, the Local Preparedness Acquisition Act,  to procure usage of  U.S. General Services Administration (“GSA”) contract schedule GS-07F-007DA with Sirchie Acquisition Company, LLC , 612 Gravelly Hollow Road, Medford, New Jersey 08055, to procure two (2) Evidence Collection Vehicles, upon complete delivery, not to exceed November 30, 2020 at a cost not to exceed $108,008.46.
